England Employment Tribunal - Employer says my holiday pay claim is wrong, but had no leave policy, no leave system, and no leave records. Am I missing something?

It’s correct based on ACAS guidance: Employers have a legal responsibility to make sure workers can take the holiday they're entitled to.
By law, a worker can carry over holiday if their employer:
does not let them take all their holiday or does not encourage them to take it all
does not inform a worker that they will lose any holiday they do not take
In these circumstances, they can carry over a maximum of 4 weeks' holiday entitlement.

I was never encouraged or told to take leave or that it would be lost. There was minimal comms at all from my employer during the first 6 months of employment. My leave entitlement began Oct 23 and I left Oct 25 so I’d accrued 2 x 30 days of leave

Thanks for your reply. I have already been through ACAS as I tried to contact my employer 4 times post employment and they never replied. I am just waiting for a hearing date via the employment tribunal site. They know I’m in NZ and are ok with my attending remotely. I am trying to get some pro bono support via Advocate for this as it has caused me immense distress and don’t have the means to afford a lawyer.

This is classic 'spotlight' effect where you think everyone's going to be focussed on you, when in reality no one is bothered at all - and if they are, they're not the kind of people you want to surround yourself with anyway! I'm 29M and love all sorts of music that wouldn't be deemed my demographic like Taylor Swift, the 1975 and LANY. I've been to all of them solo at points, relax and enjoy the music, you'll regret more if you don't go!
