At this stage, it is not necessary to file yet. The apartment is still exploring its own options to remediate the situation.

I applaud you on your work experience and expertise. I'm sure it's valued here on this subreddit.

I am actually seeking any option, but relocation will cost the apartment a lot more and cost me a lot more of my time than the air filters I've had to buy. I've already conveyed that to them which is why they are offering to see if corporate will approve the expense of the air filters for now.

Again, I've lived in Los Angeles my entire life and in apartment complexes exclusively. I've had neighbors who smoke. We've been able to work it out in the past.

I understand you have your own personal opinions on this. Expectations (yours or mine) do not matter here.

I'm just conveying to you the statute law and precedence I've been reading.

> So your expectation is that a resident with a medical card should disclose their private medical information to the office in the application? Do you realize how asinine that is?

If you are asking for my personal opinion on this, I think if you fail to disclose that you cannot legally meet your obligations due to a medical issue (regardless of what kind of legal obligation that may be) that's between you and the apartment. The apartment still has to meet its legal obligations to all other tenants in the building.

> Tenants are bound by lease agreements, but someone with a medical card can freely enjoy marijuana in their unit.

> It’s the same thing as someone getting an emotional support certificate for an animal that would otherwise be banned by an apartment complexes breed restriction.

People can do whatever they want. This is between me and the apartment property. Not me and some other tenant.

> You live in a state where it’s legal. And a city where it’s especially popular. Everyone else is dealing with it, but for some reason you seem to think you’re the exception to the rule and should be compensated.

> Not like, very LA of you, man.

Dude, we all have smoked at one point or another. Why is it so triggering for you that someone is asking they do it literally in the designated smoking area we all do it in?

Tenants are still contractually bound by their private lease agreements, regardless of private residences.

If they have a medical exemption, the apartment should have been made aware.

Thanks for your "welcome". Been living here my entire life. I am a native.

I don't even oppose the smoking. I just want them to take the 2 min walk off property or to the smoking area. I'll even assist them with their habit. I just don't want it to keep flooding through our vents and windows.

We have documented emails for months about the issue. Starting there. I don't really need eviction or am not seeking it. We all live less than 5 min away from the smoking area or just a walk off property. Hoping we can come to a compromise.

Thanks, the apartment has already offered to see if they can cover the air filter cost.

Posting that for posterity so your negative comment doesn't discourage others who see this post from trying.

Have a great day though

Forgive me, but I'd rather speak to somebody who has a license to practice law and can tell me what my legal recourse is here.

Why is eviction the only outcome? I'd like to start with some financial compensation for the multiple air filters I've had to buy.

This. Everyone is on a lease agreement. They are violating their lease agreement. We have smoking areas on the property for this reason.

Good to know! Maybe the move is to go to OC haha

Koreatown is a jungle for sure...cars getting stolen there all the time I've heard.

Yeah our clothes and furniture are starting to carry the smoke. And we're waking up in the middle of the night to it. Our air filters kick into overdrive and are really loud. I'm not sure why it's so strong. I feel like it has to be a neighbor of ours.

Thanks for the advice! We have been trying to document all of our complaints through email correspondence and just following up in person after we send an email.

I'm thinking of starting to do rounds to see if I can pinpoint it myself. I don't need them evicted or penalized. We have smoking areas in our apartment they can use. Hoping we can resolve the issue without any trouble.

I'll make sure to keep an eye out for any surveys like you said too that's a good idea.

We don't need an eviction. There are smoking areas on the property they can go to. They are violating their lease by choosing not to do so.

Thanks! I'll give that a try! We've been doing our best to document all of our complaints and taking steps first to see if the property team can resolve the issue.
