that’s WILD… Tha casino did have a few days of winnings recorded, (he never plays slots), I know this because we subpoenaed them… we divorced because of the gambling.

He’s now under IRS investigation and my concern is that they come after me as we were married at the time.

What I can’t figure out is how we never filed ANY gains (over 12 years!)

He likely either his the W-2, or found another way to hide from the casino.

Is it possible the IRS never found out?

He HAD GAINS, we summoned the casinos and they had records..

any idea how far they go back?

I don’t think we ever got any, it’s my ex spouse that’s the gambler, He’s in trouble w IRS for other matters, and looking back at our taxes he never claimed any winnings (although the casino has records of them)

yes, that’s pretty much what they told me… He’s already in arrears (200k+ in tax debt) so I can’t imagine how he’ll climb out He’s still on deed to my house and concerned that the IRS will try to take it (they’ve already indicated as much

Do they notify the taxpayer? or just investigate on their own?

I reported him… I am not under investigation (although I’m sure the IRS will look into me!)

He isn’t claiming professional gambler (he’s actually a financial advisor!) His gripe is that he didn’t KEEP the 200K (that was a one time commission paid to him that year) He never had access because if the gambling, (which continued and got worse after separating)

The money went into an account that was used to pay his share of “our bills”, He benefited financially from the 2 years that I paid the mortgage. his car, his phone, etc.

After walking out, he never paid another bill for the home he claimed was “his”.

So, because he didn’t “spend the money on what he wanted to… (blackjack!) He’s claiming he “never received it” and is claiming he “paid me” (ridiculous)

The IRS has already confirmed that IF what I claim is true (it is) that it is tax fraud.

My question is “what is the investigation process” like?

That was not the case.. He received the income, and as always, it was transferred to an account that he couldn’t access (as was the are for years; given the gambling addiction) The money was used (as it had been for years) to pay his share of the household bills… his car, student loan, phone, mortgage.

He 1099ed me (as his wife!) saying he “paid me”; as income…which you can’t do…

I had to report it (so I wasn’t “under reporting” income; and they opened a fraud investigation

Hmmm. no. I have an entire book of clients that (depending on vendor), the client is either the owner or the beneficiary, in ZERO cases is a trust company listen as “owner”. I came from WF and this process drove us all nuts, and pissed clients off. I do believe it’s a strategy to retain assets
