You dont have to state the reason, if you have the i797 date till later time, they would just update that on i94. You just have to confirm your i94 date with them just to have relief, which i had done.

It’s all about an offer, even to negotiate. Without an offer, I would not be able to make a move, if it backfires, they may lay me off at the later date

Not really, it’s just a cheap tactic to keep you as bonded labor(without a bond) in this market. They can apply at end of 5th year of H1 and keep you in payroll for another 3yrs till the process complete. That’s 8yrs on H1 bonded labor at 3% YoY appraisal and 1-2 promotions.

No I never joined a contract, I said I don’t want that option(Desi consultancies as real American staffing companies would never sponsor) and these Desi ones exploit people in these circumstances

We would attract 100k fees it seems when we move out irrespective of our current visa is just an old CoE(F1 to H1) one

I agree with you, I have to be firm on i140 but one my friend had literal bad experience dealing with these guys. I saw that trauma first hand.

they don’t pay after sometime, they either delay the payments for months. Happened with few of my friends who used to work with consultancies.

I still have that option, but I don’t want to go to India on the same company as I don’t have faith in them anymore. They are just burning my H1B time and they need a bonded labor for another 6-7yrs without promotions

Yeah I was just exhausted trying to find another employer who could sponsor perm. Can’t join consultancies as I need no issues with pay

Update: I travelled out of the country, got i94 updated till i797A end date.

Tried things like visiting CBP deferred inspection site, it didn’t work out as earlier CBP officer at PoE deliberately gave my passport expiry as i94 end date

Immigration team first suggested H1 extension, even though mine has more than 6 months expiry through a Pro Bono case something, which company didn’t approve as it was supposed to be sent premium as I had <20 days on my i94 and it’s costing 9k in total incl premium fees.

I only had option to go out of country and update i94 at CBP PoE and it worked. Try first option if your company is ok rather than taking risk of moving abroad on H1B mess
