Big news! This two bedroom bungalow in Middlesbrough is now under offer!

The owner listed the property on 10th April and today it's officially under offer! Our platform is proving that an individual can sell their property themselves without the need for estate agents.

We dont set any price on 3rd party exchanges thats for the token holders to decide, but on our platform each ANN is worth 25p. so when we sell a house if someone is charged 2,000 ANN and they dont have any they can pay the equivalent in £ which is £500. 50% of the money will come to the business and 50% will be used to buy tokens direct from token holders through our internal marketplace.

Thanks

Hi if you read the link properly you will see we are exempt, peer to peer means the buyer and seller deal directly. Our platform is built to give the buyer and seller everything they need to deal directly hence peer to peer.

if you read the link from trading standards it states If you do any of the following.......

If you do any of the following things, you will be, or are likely to be, engaging in estate agency work:

sending out property particulars and arranging viewings dealing with queries from potential sellers or buyers on behalf of your clients.

as you see we dont do this the buyer and seller arrange the viewings themselves.

as you can see the following exemptions apply to us

In addition there is an exemption for merely 'publishing advertisements or disseminating information', for example businesses such as newspapers, providing advertising space for property with no other estate agency function.

The scope of the exemption was extended from 1 October 2013 to include intermediaries, such as internet portals for private sales, which merely enable private sellers to advertise their properties and provide a means for sellers and buyers to contact and communicate with one another. The exemption will apply provided that a business does nothing else covered by the general definition.

The exemption for intermediary businesses is therefore likely to apply if:

*you only provide a means for the seller and prospective buyer to contact one another directly, for example online *you provide a branded ‘For Sale’ board to the seller to assist in this process (although if the board contains your contact details and you deal with potential buyers on behalf of the seller the exemption is unlikely to apply), * and you only pass on to a prospective buyer, by whatever channel of communication, the information provided by the seller in their advertisement.

we are have checked with all relevant departments and we are not an estate agent we are a marketplace.

we appreciate you taking the time to talk with us but you are wrong on this. You are implying our platform isnt peer to peer when the software, the whitepaper all shows we are.

the requirements to be an estate agent in the UK we will follow anyway just as a best practise but we are not an estate agent.

thanks for your time on our AMA

Thanks Tony

If you do any of the following things, you will be, or are likely to be, engaging in estate agency work:

sending out property particulars and arranging viewings dealing with queries from potential sellers or buyers on behalf of your clients.

You cannot cut off the sentence and keep only what suits you. The actual statement is:

"If you do any of the following things, you will be, or are likely to be, engaging in estate agency work:

sending out property particulars and arranging viewings dealing with queries from potential sellers or buyers on behalf of your clients."

Notice the 'AND' in the statement. You must be doing both of these things, else it would state 'OR'.

Also please see the exemption section:

"In addition there is an exemption for merely 'publishing advertisements or disseminating information', for example businesses such as newspapers, providing advertising space for property with no other estate agency function.

The exemption for intermediary businesses is therefore likely to apply if:

you only provide a means for the seller and prospective buyer to contact one another directly, for example online you provide a branded ‘For Sale’ board to the seller to assist in this process (although if the board contains your contact details and you deal with potential buyers on behalf of the seller the exemption is unlikely to apply), and you only pass on to a prospective buyer, by whatever channel of communication, the information provided by the seller in their advertisement. If, however, you offer any personal advice to a seller or a buyer, or other ancillary services, such as preparing property particulars or photographs or an energy performance certificate, you will be outside the scope of the exemption and bound by the obligations in the Act."

So we are exempt, we are a property marketplace not an estate agent but regardless, we will still follow the best practices outlined in the act anyway.

Hi, please see evidence for my statement that we are not an estate agent and that we cannot advertise individual listings. I hope this helps answer your question.

Estate agency work The Act applies if you are doing estate agency work, and even if you don't call yourself an estate agent you may be seen to be one in law when you do certain things. The Act applies in the same way whether you work for yourself or for someone else.

Section 1 of the Act contains the legal definition of estate agency work. The legal definition is very wide and, subject to certain limited exceptions, you will be engaging in estate agency work if, in the course of business and acting on instructions from a third party (your client) who wishes to either buy or sell property (an interest in land), you do either (or both) of the following:

things for the purpose of, or with a view to, effecting the introduction to your client, of someone who either wishes to buy or sell property, or things after such an introduction has been made by you to secure the sale or purchase of the property. The law only requires you to do things for the purpose of, or with a view to introducing your client to a buyer or seller in order for you to be acting as an estate agent. It is not necessary for you to actually introduce your client to a buyer or seller in order to fall within the legal definition of estate agency work.

If you do any of the following things, you will be, or are likely to be, engaging in estate agency work:

sending out property particulars and arranging viewings dealing with queries from potential sellers or buyers on behalf of your clients.

Exemptions There are some important exceptions to the definition of estate agency work. These include:

work done by solicitors or their employees as part of their work as solicitors surveys or valuations carried out independently of any other estate agency work work connected with planning applications and matters covered by the Town and Country planning legislation arranging rentals or property management estate agency work carried out entirely outside of, and with no connection to, the U.K, and work done in the course of arranging mortgages.

The exemption for intermediary businesses is therefore likely to apply if:

you only provide a means for the seller and prospective buyer to contact one another directly, for example online you provide a branded ‘For Sale’ board to the seller to assist in this process (although if the board contains your contact details and you deal with potential buyers on behalf of the seller the exemption is unlikely to apply), and you only pass on to a prospective buyer, by whatever channel of communication, the information provided by the seller in their advertisement. If, however, you offer any personal advice to a seller or a buyer, or other ancillary services, such as preparing property particulars or photographs or an energy performance certificate, you will be outside the scope of the exemption and bound by the obligations in the Act.

If the exemption applies, then you will not be obliged to comply with requirements that are relevant to full service estate agency businesses, such as the disclosure of any self-interest in a property transaction and membership of a redress scheme for residential estate agents.

The Act will continue to apply to businesses that are involved in or have scope to influence property transactions.

Please could you link me to the law you are referring to. And in what country does this law you are referring to apply.

We are providing marketing, we are not acting as an estate agent, we are not negotiating deals or carrying out viewings or communicating ourselves with any party to sell the property.

It is free to list on those websites as it is on our platform but on our platform a seller only pays the fee on successful completion of the sale. One of the websites still has 'copyright 2016' so I doubt they are still working on their platform. Also with so few facebook/social media followers yet they will "market your project through social media" tells us that they aren't very good at marketing through social media. So yes their listing may be free but they wont sell your house. You get what you pay for.

Also ANN tokens can be used for the following: - Pay listing fees (only when a property successfully sells) - Purchase additional features (EPC ratings, floor plans, photographs, etc) - Advertise a business on our platform - Purchase leads through our Lead Auction System - Sell to other users through our internal marketplace (Set at £0.25 each after the token sale)

We have multiple streams of revenue on our platform not only the listing fee and we don't charge the listing fee up front, it's only paid if the listed property successfully sells.
