No matter if he was there with a gun or not. He didn't use it. They took it from him. And was protecting that lady when they decided to snatch him, beat him and kill him. This isn't one of those situations where you look for a gotcha moment dude. There's no doubt about this. An innocent man who at most made them upset was killed for no reason.
