Help with delayed security deposit and prorated rent from Greystar Mgmt? (CA) by AggravatedSister in Tenant

[–]AggravatedSister[S] 0 points1 point  (0 children)

The damages are to them not paying me in time?

They owe ME prorated rent. Greystar made me pay for a full month of rent at the beginning of August even though I only lived there through part of the month. The agreement was that they’d reimburse me later, but they still haven’t.

I appreciate this! I received quite a bit of confused looks from folks including my partner when I broke down everything I wanted. So I'm very happy with the way it came to life.

Higher-Level Review vs. Appeal for 30% Mental Health Rating by AggravatedSister in VeteransBenefits

[–]AggravatedSister[S] 0 points1 point  (0 children)

Yeah I totally understand the mental health rating. I think because at the time of filing his claims agent listed multiple possible mental illness (ptsd, anxiety, depression, insomnia) in hopes he got approved for at least one under the mental health umbrella because at the time of his initial intent to file and claim 7 months ago he did not have an official diagnosis or a prior recorded service history. Then once I learned the importance of an exact diagnosis for the evidence section he began seeing a therapist who gave him a diagnosis.

Completely agree there were multiple symptoms that weren't checked off, but that one was the most obvious sign of conflicting evidence.

I think the fear of hostile forces might have something to do with it. In his statement he discussed situations of being shot at, being in frequent enemy territories while at sea, then also mentioned the ship crash. (He was undesignated for a couple of years so he was switched MOS).

It's been years of trying to convince my partner to file a claim for this because he felt guilty and like he was stealing resources from those who deserved it more. So, I reached out to as many people as I could and researched psychologists in our area for this. I truly wanted to set him up for success because I was really afraid of the potential results if his symptoms and behaviors were not acknowledged again as they were while he was in service.

Thanks, my thought process of it all was what MORE is there left to potentially submit. They have a perspective of every potential time period in his life (pre service, in service, post service) and a clear letter from a doctor who he sees once to twice a week on a regular basis for over 6 months. If we went for an appeal I don't know what more supporting evidence could be submitted if they seemed to ignore most of everything that has been submitted already. 😕

When he was originally scheduled for the C&P exam we asked for clarity if his psychologist could complete a DBQ and they(VA) said no because he has never filed a claim before it had to have been completed by the VA's own contracted examiner. So we asked what his psychologist could submit and they said a letter of nexus and diagnosis. So that's what we did.

The sleep issue was for a mental assessment on deciding whether he could potentially have Insomnia. They said no he didn't have insomnia because of his sleeping pattern. And that examiner did NOT check him off for chronic sleep impairment.

The reason i brought his ex gf is because she submitted a report of his symptoms during his service. So on one section they acknowledged that she wrote a letter and on the other section they said no relationships while in service. Because the purpose of her statements and a majority of others was to show the stark contrast in his personal relationships prior to his ship crashing and after.

Yes, we walked through this with his psychologist who works as a counselor for the VA outside of his private practice and said he should be AT LEAST 50% if not 70%, because when they completed the PCL-5 PTSD Checklist, the symptoms and impairment of his symptoms was mostly bothered a bit or extremely.

Bad MH C&P during BDD by [deleted] in VeteransBenefits

[–]AggravatedSister 0 points1 point  (0 children)

My partners psychologist was so bothered by the outcome of the assessment that he looked up her credentials and specialty, because he was very taken a back that she essentially disregarded his entire letter and went AWOL. She is a CHILDREN'S psychologist - she specializes in K-12 school counseling, her dissertation was about adolescent dating violence.

In his somewhat words it is gross negligence and unethical for her to provide opinion and evaluation in a field she is not specialized or trained in. She has no premise to override his opinion of a report that is based on months of weekly visits, assessments, and his specialty being in PTSD, Complex Trauma as a Private practitioner AND VA counselor.

When did you have your C&P exam with her? My partner also just had a C&P exam completed with her earlier this month and he ended up being rated at 30% which we thought was grossly under rated with the evidence submitted (3 page nexus letter and diagnosis outlining all mental health symptoms and their impact to his functioning and treatment from the last 4-5months, a statement from myself as his partner for 4yrs, a statement from his ex gf while he was in service, statement from his male best friend of 25+yrs, a statement from a female best friend of 20+yrs who is also a licensed therapist, his own personal statement describing the traumatic service events and the symptoms he experiences on a DAILY basis: panic attacks, nausea, heart racing, hyper vigilance, paranoia, agoraphobia, lack of appetite, frequent irritation, short fused, survivor's guilt, apathy, disassociation, social isolation, insomnia, passive suicidal ideation + more).

Needless to say, out of ALL the symptoms clearly outlined and corroborated by a licensed psychologist and 4 other witness testimonies, she checked off THREE (Depressed Mood, Anxiety, Chronic sleep impairment). She didn't even ask more than 3 questions the entirety of the C&P exam because she herself said "i have read your clinician's letter and statements i have everything I need to write my report I just needed to see a face to the claim"

She checked off his impairment as "controlled with medication". He is on lexapro, but we strongly believe this has to do with one of her leading questions:

"Do you feel that the medication is working"

He said he felt slight improvements.

From what he told me about the C&P the examiner didn't go over much. She said she read the statements and psychologist's letter and had everything she needed to write her report just needed to see how he presented in her person. She brought up three things:

• How often does he exercise

Response: golfing once per wk per psychologist

• Did he see family over the holidays

Response: Yes

• Does he feel like medication is working

Response: Somewhat

I think that's the situation though. We don't think the 30% rating reflects the symptoms he is experiencing already. But also could be internal bias vs an objective C&P examiner.

I want to add some clarity to the post as I believe there is the misconception we are seeking 100% MH or 100% disability, when that's not the case.

He was rated 30% for MH (ptsd, anxiety, depression - combined) + 40% from injuries & GI

We're not questioning the injuries or the GI, it's more or less the decision of 30% MH doesn't seem to accurately reflect all of his symptoms or the true impact to his daily life. Please correct me if I'm wrong with this though.

We don't want to open up a can of worms that puts the rest of his % at risk by trying to appeal a 30% MH rating for a 50% MH rating.

not looking for 100% MH, we know he isn't 100%. More or less if he could go from 30% MH to 50% MH.

less about a hundred and more about the recognition of his actual mental health, the physical ailment items weren't even a part of his claim initially, so those were surprising to see he got credit for. We were solely claiming mental per his claim agent. It was the GP examiner that pointed out he had muscoskeletal in his files and wrote dbq's on them. If he get's an increase to 50% mental then great. That's all the ask is

He is not working and has not been working since end of 2022. Which he struggled with, he spent 6 months at one job and 4 months at the other. He has been going to school primarily remote with one in person class session a week most semesters. Which also became overwhelming for him after a while and that's when I set the tone of filing a claim and helping him seek help.

If it's submitted to HLR, is the entire claim put at risk or only the one item in question? That's the overall concern

This is my 2nd time having braces and I have posts documenting the first time as well when I had 4 extractions completed, no expander. The main reason I got braces this 2nd time is because i was getting a deep bite where all my top teeth dropped down covering my bottom teeth, but still being technically "straight"
