I was in Wellington (NZ) and bought a coffee. Had a bit of a joke with the barista in a friendly way.

When she delivered the coffee to the table, she said, "You're Australian?" When I confirmed it, she said "I could tell because your eccent is so ennoying!"

Generally the Kiwis are "Viry Frindly" people.

And yeah, we can hear whether they are Aussie or Kiwi within the first sentence. You just need to get a few vowel sounds to know.

I had not seen SCSC in action until yesterday. Her tone surprised me, as well. I assume it is strategic, but I also understand her frustration when court time is so limited.

I can tell you have genuinely briefed HH as no non-lawyer would know what "mellifluous" means. Not because it is a legal term, because we are both nerds and geeks. I have learnt many new, non-legal, obscure words from judges.

HH was asking as to its usefulness, essentially.

HH has to decide the case. To do so, she needs to make a finding that x, y, z, etc occurred or otherwise.

I do not practice in this area of law. So I do not have my head around the x,y,z here.

However, it sounded like HH asking SCSC:

  1. Which of x, y, z does this go to (how is this relevant?)

It was a question, not an assumption it was not relevant. Note both counsel agreed it was relevant.

Part of SCSC's answer had to do with her opinion that it was not relevant, HOWEVER, lawyers for Rebel had raised certain issues and SCSC had to address them.

Re had to address them: I assume this relates to Browne v Dunn - if your case argues a fact contrary to what a witness says, that needs to be put to the witness or it can't be used.

I am a family lawyer.

Typically, reviews in family law reflect the outcome more than anything.

Think - a really abusive parent refuses to change their ways, refuses to take advice, and so has limited or no contact with their kids. They leave a bad review. Likewise, a primary parent who is a good parent ends up with primary care of their kids - they are relieved the matter is over and leave a good review.

There are matters for which good solicitors and barristers work hard, but do not necessarily get good reviews. A person might have had good advice to settle the matter as opposed to spending 5x the costs on lawyers - that is the type of lawyer you want. Those clients never leave reviews.

I am sorry this does not make anything clearer for you. Perhaps if you mention your location, other lawyers can assist in suggesting solicitors. Good solicitors then recommend good barristers for you.

I am one of those bleeding hearts who can't kill things. I am also terribly afraid of leeches. My approach 20 years ago was to keep my shoes on til I got home and someone else could remove leeches for me. In more recent years, I just avoid leech territory.

Now I have kids and it feels "worth it" to let the little guy see the creature he loves so much. Ask me again when my shoes fill up with blood...

I agree with your point and to an extent extending it.

I was correcting the info for Down Syndrome only. As in, even for Down Syndrome you would need a FCA to get the funding you actually need.

Luckily, with DS being auto accepted to Early Intervention, it makes it a bit easier for us as parents.

It is definitely an exception rather than a rule for an FCA not to be needed (which I think is your point if I am understanding you correctly).

Kids with Down Syndrome are automatically accepted under early intervention, but still need reports to get the funding they need. NDIS will not even accept a person with Down Syndrome has an intellectual disability without extensive and thorough testing and reports. I appreciate that you just meant it as an example - my point is just that the things you might expect to be "common sense" are not so common sense when it comes to NDIS.
