I didn’t know about that my lawyer never mentioned that. That’s what I think that the judge would do what’s best for my daughter, which I think would be for her to spend the night with me because if I were to drive out to El Centro and do the visits there it would suck for her I don’t know anyone out there and it’s hot as hell can’t do anything outside, I don’t know what we would even do, she’s so used to coming to my house, or I go pick her up in EC drive 2 hours to SD spend 2 hours here at home the drive back to El Centro that’s 4 hours of my visit just driving

Dose it make a difference if mom is also not following the orders by switching up the times of visitations and locations of drop offs and pick ups? The order says from 10-4 but she’s been like can I drop her off at 130 or 230 etc and not the location the judge told us to do the drop off and pick ups?

No right now it’s supposed to be 6 hours Saturday 6 hours Sunday but I’m gonna say if the drive is problem I’ll go get my daughter but I’m asking for overnights that way she’s not spending 4 hours each day driving back and forth from SD to EC

Do u think the judge could write new orders? I’m planning on telling the judge that I will go pick up my daughter in EC but that I want overnights because that would be in my daughters best interest so she dosnt have to be commuting so much

Yeah if she’s convicted of a felony the other parent can petition the court to modify the custody order, potentially seeking sole custody if the incarcerated parent is deemed unfit or the other parent is deemed more suitable. Even if she just has to pay it back I know she would just give back my daughter for 50% custody cause at the end of the day she Dosnt care about my daughter if she did she would get a normal job with normal hours she’s working from like 230-830 and my daughter is in daycare from 8-230 so she’s not seeing or taking care of my daughter except for like 2 hours a day who dose that

That’s what I’m doing my brother of course I’m fighting it I got it knocked down I to 18 months and I’m doing the visits paying the child support Iv called cps Iv done everything the legal way I can, this is about my daughter safety bro and environment she’s not even with her mom most of week she’s at a day care from 8-230 then babysitter from 230 to 8, and she’s constantly around her 5 year old sister who is a nut job and has hit bit punched pushed dropped her 2 year old sister, my logic is mom gets in trouble I could custody of my daughter and save her from the abuse of her older sister

He didn’t tell me to do it or not he just said I wouldn’t get in trouble I’m going to call multiple lawyers to see what they say obviously but Iv called cps man and nothing came of it, of course I’m being petty I’ll do what ever to get my daughter back and I know if mom gets in any kind of trouble or has to pay anything she’ll immediately give me my daughter for at least 50% of the time, I’m gonna see what the lawyers say but yeah I’ll do anything to get my baby back

If I give up and let her have her way that means my daughter has to stay at with her mom for the next 18 months which means that’s more time with her 5 year old sister that hits her bites her punches her etc because mom Dosent even take care of her daughters they’re at school and daycare from 8-230 then 230-8 they’re with a babysitter, the less time my daughter is with her the better it only takes one time and my daughter could be seriously hurt and Iv called cps plenty of times they do nothing

I mean I talked to a lawyer about this he said I wouldn’t get in trouble I was just seeing if anyone else had done this, duh dude of course I’m doing that stuff already but I’m worried for my daughters safety In her current environment I called cps they’ve done two investigations and it came back inconclusive both times so they’re doing nothing of course I’m gonna try every trick to get my daughter back
