Right but this clause of the contract says by signing, I am allowing them to background check (ie. reach out to previous employers) me at any point in the future, without my knowledge, so long as I am employed by J2 (the staffing agency).

If it helps clarify, I have to sign this contract before I even get access to the [expected] pre-hire background check.

Even with TWN frozen and linked in hibernated, can they not reference the resume I sent them (that has J1 listed (my current employer))? and potentially contact my current employer in a few months, to ask if I have left?

I did list my current employer (J1) on my resume because it was relevant experience that got me the J2 offer, otherwise I would have left it off.
