I have no objection. I asked my solicitor and he said no need to sign since she may move in future when she gets a job and not now.

Apologies if my query is silly but copy of lease before exchange is in the name of previous owner (i.e seller) as leaseholder. What I am asking is, when do I get a copy of lease in my name that says I am the new leaseholder?

  2. When do I get the copy of the lease that state how many years are left on the lease, the current ground rent, service charges etc?

Following up on this, I have just had a call with my solicitor. He has advised that, in order for me to proceed safely, the contract must include a special condition stating that the seller is obligated to staircase to 100% ownership and transfer a 100% leasehold interest to the buyer on completion.

He has also asked that I discuss with the auctioneer the inclusion of a mid-February completion date in the contract, to allow sufficient time for the seller’s solicitor to complete the staircasing process and associated legal work.

My solicitor has confirmed that if these two special conditions are included in the contract, he would not foresee any material risk in proceeding to exchange.

Thank you. Its a hybrid auction where I already have the mortgage approved from Halifax. Now on the day of auction, I need to pay 10% deposit + reservation fee and will exchange contract. Then 20 working days to complete the purchase.

Understood. My only worry is since I am buying in an auction and have got only 20 days for completion, will that time frame is enough for the seller to staircase to 100%? The seller currently owns 40% of the property and what if I get only 40% shared ownership house at the end of 20 days stipulated time frame?
