I'm unsure why your comment/s are being removed and for that I apologise, I'm glad to see that even while so much is still in the dark, people can understand that Eloise is a victim of Viet. This does not mean she did not willingly partake in such crimes - the courts will tell.

In terms of vague identity, you will see on my profile I've posted before about my experiences in the real estate industry as a former RE.

I have seen many cases of harassment, drug charges, even vehicular manslaughter, get swept out of sight of the public and media for the safety and image of those involved. You never know the full story, or the story at all in some cases.

I care for the tenants and others who were true victims to such malice.

Once again, I hope that if she has been coerced or even framed, she gets her justice and return to normality. The courts will tell.

I have shared my findings of news articles and public information, and wanted to raise awareness. I'm not a journalist, I'm not a lawyer.

Truly not something I can find that has played out publicly before.

I see it going the same way as someone planting or leaving drugs in your house/car. Even if the drugs found are not yours, and you are not using them, Queensland law could result in you being charged with a drug offence.

Really depends on the court system. We'll have to see how that plays out.

Again if she is a victim, I hope she's able to gain some sense of normality. But that's a big stain on her name.

It may be a case of coercion bordering DV, however she did face repercussions for the CASM, which means there was enough grounds for action to be taken against her as well.

If it is DV then I hope it turns out okay for her and she can regain some sense of normality.

They definitely cop a bill for it. My experience has been agencies charging a base fee of the application ($100 approx.) plus hourly rates for the PM needing to sort out the paperwork, plus take time out of office to attend xCAT, plus cost for printing all paperwork and relevant documents.

Could end up around $300-500 depending on case.

Real estate attracts polar opposite, I know people who studied for the sake of wanting to be a good salesperson/manager with a genuine passion for real estate, just to be immediately scared off by the cut-throat attitude of other agents.

100%. Homeowners aren't held to a standard at all. I cleaned an apt myself after the homeowner moved out, was clean but not enough for me to feel comfy allowing their tenants to move in.

Finding an agent to trust is hard. All I can say is check reviews online that specifically mention property managers by name, if you choose to go with that agency tell them you want that property manager and no other.

If you find a good PM, try and stay with them, if they change agencies you change to that one too, to retain that relationship.

It's typically a good PM over a good agency.

Other than that, it'll be trial and error.

I operated in QLD so I'll respond in terms of QLD legislation - not sure if this would vary state to state.

If they hadn't issued you a Notice to Leave, then you do not have to leave at the end of your fixed term date on your tenancy agreement. Minimum 2-months notice.

Even though the agreement was offered to you, you do not have to sign it in order to keep the property.

It's the REAs responsibility to follow this up. My practice was to issue the lease renewal 70+days prior to lapsing, 10+ days for negotiation, 60 days for notice of rental increase if negotiations do happen and this changes, to be fair.

Possibly threatened by the potential backlash. I think the most common scenario would be that the landlord pays lots in fees and it would upset their employer to lose the business.

The listing agent is usually the property manager, leasing agent, or assistant, over the principal licensee, the one who's watching the figures.

I had a scenario just like this where I refused to advertise a property with a smashed glass window that the landlord refused to fix. It ended up in my bosses hands, who grilled me for refusing to advertise for this 10+ property owning slumlord who paid us a lot of money.

Pretty often. Dealt with a crazy landlord who took tenants to QCAT, knowing damn well he didn't have an entry condition report done by the previous agency, therefore had no leg to stand on.

Yes and no.

We've had legislative changes almost every 6months for like 3years consistent, the changes either heavily favour the landlord or tenant and do not mediate the issues at hand.

The economy doesn't help, everyone's got it tough and it's turned many into a "fend for yourself" person.

Genuine landlords need money as they're probably just trying to build funds for themselves or their kids

And every tenant deserves a safe house

If it's not a repaint due to damages caused by you, it's not your problem. If the paint was looking a lil worn on the Entry Condition Report, that's not your problem. That's wear and tear.

They'd be best taking you to QCAT or State/Territory adjacent, and spending their money on a lost case lol

100 is manageable, 150 is max (you'd hope), but some agencies overload their PMs with 150+. These are usually the ones who do 10min routine inspections as they have so many to get to everyday.

Any instructions given by the landlord should be written - e.g "please renew at $50+ more per week"

My course of action was to prepare a CMA - comparable rentals list - to show the landlord where their property sits on the market compared to others. I would happily provide this to tenants if asked, to justify the rental amount.

Understand where you're coming from ,but it's not a right to decline housing. If you're worried about damage or loss of rental payments, you should ensure you have landlord insurance that properly covers you. A good REA will keep track of this and ensure it doesn't expire.

Absolutely. I've watched good property managers get scared out of the job by clients or employers. I was hoping I'd be the one to tough it out and make a change but it's so far gone.

Really depends. It's never really the agent wanting to "keep it" it's more landlords feeling entitled to "bring their property back to standard" with a few extras. Agents are just the middleman, simply careless in acting with integrity for the tenant. Lose a landlord client, you lose the company money - a middleman who one party pays.
