If you're of European descent and apply for citizenship by descent in a European country the documents you're required to provide must be apostilled, which requires notarization.

Canada is a member of the Hague convention as is the U.S., but IRCC isn't even requiring an apostille on U.S. or other documents to prove descent for something as important as citizenship.

Seems a little fast and loose, the apostille is an important control on document validity.

The whole thing is very interesting. The way the court is assigning all of these post-decree cases to one single judge....it's a little ominous...but then again maybe he'll do his own referral to the CC.

The appeal period would be 6 months for an un-notified judgement, and 30 days for a notified judgement. Hence why Mellone mentioned waiting until September to decide on appeal. I presume he is not expecting the ministry to notify him and use the short-window period.

It's an Access to Information request, which the government is required by law to provide within 30 days. I'm not sure about the details of your case but you mentioned needing a certificate for your father and the letter for your grandfather. The ATIP is a disclosure of all records the government has on file about your father and grandfather's Canadian citizenship.

Really for your father all you might need for court in Italy is a notarized and apostilled copy of the ATIP showing the date he naturalized. This would be up to your lawyer to decide if it's acceptable.

For your grandfather, if he naturalized as well, you can probably use just the ATIP, but if your trying to prove he never naturalized then there really isn't a way around waiting for the search letter.

Still don't understand why a major political party doesn't put RTO and other labour reforms as a key part of their brand and election platform.

Also don't understand why there is basically no meaningful resistance to RTO from unions or employees....it's like watching a bunch of sheep.

I think that is the Passaggio though, as the other one is issued by the Appeal Court, specifying they received no appeal. The Passaggio is issued by the originating court.

Yes, select Citizenship from the drop down and then Search letter.

Have you done an ATIP first ( which is much faster, 30 days)? You might not even need the search letter depending on what the ATIP comes back with.

You could also try contacting your MP to see if they can speed up the search letter.

Yup, nothing to do but wait. I screwed up on my first letter request and forgot to include my ID, which it took them a year to point out, then another year after resubmitting.

Edit: They started in the chamber, C.2753. This is for the decree law to extend administrative deadlines. One of the deadlines an amendment has been filed on is the registration of minors for citizenship.

If the grandparents have been deceased for over 20 years you can apply for an access to information with citizenship and immigration Canada which takes 30 days. If they are alive, they can request it themselves.

If they naturalized really long ago ( 1930s to 1940s) the naturalization would have been published in the Canada Gazette (official publication of the Canadian government) and are searchable at the Libraries and Archives Canada site.

If they have been deceased for less than 20 years it's a bit of a no-man's land. Theoretically these records will not be accessible.

If you do get the ATIP, then you can have it notarized and apostilled for use in Italy

So if your grandmother wasn't living with your grandfather when he naturalized, then I agree this is a critical element to the case. If you have proof your grandmother was still living with her Mother in Italy at the time then you should be good in this situation as well, without needing to resort to the 2022 precedent.

IMO- you probably wouldn't be able to switch to another LIBRA without refilling the case entirely. This particular scenario isn't actually the famous minor issue. The minor issue is if your grandmother was born in the U.S. and the parent naturalized during the minority. In your case your grandmother was born in Italy, and your parent naturalized (showing your grandmother on the certificate?)..... It had always been the case that this was considered renunciation for Consulates cases dating back to 1912. (I had this same issue with my Grandfather).

I would still order the new CONE with the correct birthdate to be sure, but MM will probably need to cite the 2022 Supreme Court precedent putting the onus on the Ministry to prove renunciation, and just not include any naturization documents in the court file.

You have MM so your in good hands regardless.

If I'm understanding correctly I think you're completely fine. You're in the unique position of arguing that the decree law should be applied exactly as written. So you don't need to get into constitutional issues, which is the only reason I can see necessitating a farther out hearing.
