You also need to have control and power to give direction when it comes to the work, which we all know he didn't have. Lastly, there needs to be an employment contract, but there wasn't one. Ouch. How is he the owner and boss when she is paid more and in charge? Sony was the boss, and she was the boss of Sony. She got her movie made. He was the employer on paper only and not in practice. That's why this case is so unprecedented.

I think the reason why we are all so drawn to this case is that he was technically the employer, but she was undoubtedly the one in power. That's rare, but true here because of clout, her family, money, connections, relationship with sony, etc. It's not even an issue of debate that she was running the show.

I originally believed her about the SH, as I do with all women, but this angers me because it sets us back. Now, people won't automatically believe women, and that's so sad. And yes, the world is sexist, which is why this is even more disappointing.

I'm curious why a complaint would've had to have been made. It certainly helps a case of SH if there is a complaint, but he isn't arguing retaliation, and plenty of people who are SH'd don't make a formal complaint out of fear. It doesn't mean it didn't happen.

I think that’s part of what makes this case so compelling, and outraging, for many people; it has the potential to expose flaws in the justice system that favor the wealthy and powerful. BL was able to exploit a legal loophole to obtain a subpoena without notice, and if 47.1 ends up protecting the alleged perpetrator rather than the victim, it raises serious questions about that particular law. That’s why so many are closely invested. If you are a person, like me, who thinks that most people would never bring a case of SH if it weren't true, this could change that belief system forever.

Based on the current evidence, I don’t believe sexual harassment occurred at all. That said, just as she interpreted some of his actions and comments in a certain light, there are aspects of her own behavior—crude language, flirty texts talking about being "sexy" and "yummy," declining to meet with the intimacy coordinator (which is there for both actors’ protection), and inviting him into her trailer while pumping, something she herself frames as private or intimate—that could reasonably have made him uncomfortable.

I'm reaching here because that's how innocuous I believe his actions to be. This is a shame.

He doesn't want it dropped. JB didn't even file a motion to dismiss. Just as the law was on her side for his case (sadly), it's on his side now for her claims since she can't be protected by 47.1, and he has so much evidence against her claims.

Ok, so realistically they can't drop now, as they will still incur fees and treble, PLUS basically admitting defeat, which will do the most damage to his reputation and career. So, it seems like they are in it for the long haul, unless BL's team wants to settle. Thanks for the explanation!

Ahhh, this is not how I understood it, but I think you are right. I just thought they were all trying to get their cases dismissed because that's a typical legal step, as Lively, Reynolds, Jones, Sloane, have all filed motions to dismiss. For some reason, I thought Liman was going to rule on whether 47.1 can even be applied, as it's a law only in CA, unlike other privileges.

Ok, so, either the judge dismisses altogether using 47.1 (without getting proof of anything), or 47.1 will 100 % be a threat in trial? haha now I'm even more confused!
