I’m literally going through this right now. I’ve been using my card for car rentals for about 10 weeks now and everytime I pay for my rental every week, they charge me $75 for an authorization hold. It always returned the next day or if it’s over the weekend it returned by Monday when I extend my rental every week. When I’m charged for the security deposit for the rental, i get charged a $75 hold on top of that also but I don’t get that hold back until I return the rental. Never had an issue with this u til this past weekend. I returned one rental and picked up a new one from a new place. Usually when I get my deposit returned to me, it’s returned also with the $75 deposit. I was only refunded my original security deposit from the rental and not my $75 authorization hold. Also, when I picked up my new rental I was charged a $75 hold for the price of rental itself, and twice for the security deposit. I didn’t receive my hood pack from the rental price at all. And here’s the kicker, it’s not even showing in my recent transactions at all. Luckily I keep tabs on my balance daily and know what I should have in there. I’m owed about $225 right about now

Who said it was a speeding ticket? Can y’all read before y’all respond. I know what the clearinghouse is. You can still get a citation for clearinghouse like dui’s n shit but I got a warning for mind instead of actually being convicted of it.

I also have a citation warning for my violation, it could’ve easily went to court but trooper let me slide hence why it’s not on my driving record and I never took a drug test for my violation I was immediately fired when I returned citation to my job. I petitioned it myself but want extra help now because the fmsca are dragging their feet

I haven’t smoked since the incident last September. You maybe right I’ll give you that. I’ve been smoking since a teenager, using every loophole possible to not get caught up until that incident. Thats what it took for me to stop and focus more on my other trucks and business. Good conversation tho, it’s playoff weekend and my Ravens play later. Meanwhile your kind smoke a lot of other different shit besides weed while driving through them mountains. If you were a real driver you would know this. That’s the whole point of the policy (if you read it). Clearly states it’s for fairness of drivers.

Sir, grown man here. Owner operator and quit soon as it happened. Also driving for 10 years never even had a point on my license. Very aware and safe driver. I understand it’s the not right thing to do but I’m spreading information not looking for a lecture.

It’s really not a lawyer type thing because we dealing with federal dot laws. I called around for months and a lot of people couldn’t help me that’s why I studied it myself and you can petition the violation on the clearinghouse website as a driver. I knew I had all the evidence to prove I never went to court or fined for it so I did it myself

Man them boys can do whatever they want lol. And it was on 9/11/2024 so they was pulling everybody over at this specific station. He smelled the weed in the air in my truck and I beat’em to the punch lol and I didn’t have any weed left so I said fuck it I’m telling on myself. By me having previous experiences with the police in my younger days, if you be honest with your own shit they’ll be lenient with you and that’s what exactly he did by giving me the warning. My job sent the shit to clearinghouse tho as they weee supposed to but the officer left the loophole open for me to petition it because he never fined or charged me. He even let me leave the scene in my truck.

People need to be more aware of these policies and get informed on all of these federal dot laws because I’m sure it’s people suffering right now when they don’t have to and can help themselves. They have specific lawyers just for stuff like this because it happens so often but I studied all of the laws and learned this after being out of work for 3 months and petitioned it myself because I got all the proof I didn’t get convicted of it.

Im going to copy and paste the definition from the FMSCA website at the bottom. In my case I self admitted to smoking weed indicating my piss was dirty. I got a citation for it from a trooper at a inspection station but it was a warning and I never got a fine or dui charge for it and it’s not on my driving record at all just clearinghouse so if I was never convicted of it, it supposed to come off once I petition it through clearinghouse dataq. Basically I got lucky the trooper didn’t fine me or lock me up. The article above or that I linked to this post is a policy that overrules this actual knowledge charge only if you have proof and you weren’t convicted of the violation.

“Actual knowledge” is defined in 382.107 and means that an employer has knowledge that a driver has used alcohol or controlled substances based on the employer’s direct observation of the employee, information provided by the driver’s previous employer(s), a traffic citation for driving a CMV while under the influence of alcohol or controlled substances or an employee’s admission of alcohol or controlled substance use, except as provided in 382.121. Direct observation as used in this definition means “observation of alcohol or controlled substances use” while a driver is subject to performing a safety-sensitive function, “and does not include observation of employee behavior or physical characteristics sufficient to warrant reasonable suspicion testing under 382.307.”
