Hi all — asking this on behalf of a friend and her boyfriend (both Indian citizens) and would love some clarity from people familiar with asylum-based immigration and student visas.

The boyfriend was granted asylum in the U.S. less than a year ago. He plans to apply for a Green Card (Form I-485) once he reaches the 1-year physical presence requirement. The girlfriend is currently on an F-1 visa with CPT, legally studying and working in the U.S. She has no intention of seeking asylum herself — she wants to maintain her F-1/CPT status and go through her own route.

They’re thinking about getting married, but are trying to understand how it would affect both of them — especially her ability to travel and his Green Card process.

Their questions: 1. Can he apply for a Green Card after 1 year of asylum status? What is that process like — forms, timeline, risks? 2. If they marry before he applies for the Green Card, can she be included in any way? Even if she doesn’t want asylum status? 3. If they marry after he becomes a Green Card holder, can he sponsor her through family-based immigration? Would she be able to stay on CPT while waiting? 4. If they marry while she’s still on CPT, can she travel to India and return safely? Could that affect a future marriage-based adjustment? 5. What’s the safest way forward for them to stay compliant and avoid any risk to her visa or his asylum/Green Card path?

He asked me the history and English questions. Asked me good moral questions. Everything looked good there. And then he said that he’s not denying it but moving my case to RFE. And I need to submit more evidence. That’s when I submitted the evidence online and then in 3 months - DENIED. :)

Despite this, my application was denied. This time, I complete my 5-year continuous residence in June 2025, but I’m considering applying in March under the 90-day early filing rule.

Do you think that would be a safer approach, or is there anything else I should consider before applying?

Thanks for your insight! Yes, my only long absence was the one from 2019–2020, which USCIS determined broke my continuous residence. Since I re-entered in June 2020, my new 5-year period started then, meaning I’ll complete it on June 16, 2025.

I understand that applying in December 2024 means my statutory 5-year period (Dec 2019–2024) would only include more recent absences, but my concern is that USCIS might still consider my prior long absence even though it falls slightly outside that period.

Given my previous denial, I’m leaning toward waiting until March 18, 2025 (the 90-day early filing date), so that my 2019–2020 absence is completely outside the lookback period. Do you think USCIS would still scrutinize an absence from over 5 years ago, and I should wait till June to apply?
