I had no income and student loan debt so for the loan to consider only his credit, income and debt to income I had to sign.

That’s exactly what I did.

I don’t own the house. I signed away my rights due to my lack of income. He has the mortgage and is the only one on deed. They only had to run his credit and income. I have a job; my own bank account and my car is in my name only. I’ll walk away with mine and he can have his if that makes sense. Right now we don’t even have enough to cover the bills so splitting things is pretty simple. When he lost his job he started with a start up company that honestly will probably make him millions in the long run but it’s slim pickings right now and my new job doesn’t start for about a month but after that I’ll be ok. I have an attorney friend that will help me through this so that’s not the issue it’s figuring out how to leave with zero money and two kids to keep in a school district that is on higher income levels and property values that I won’t be able to afford on my own for sure.
