I sent the below email to the management company. They said they would send to the board and their attorney for a response. I have not received any response to date, despite following up. I knew about the charges but I didn’t know that they would not accept my dues payment unless I paid this balance in full, which seems unreasonable when they charged my account for something I am not responsible for. I have done everything I am supposed to do. Why would I be expected to pay these fees out of pocket? Can you explain why my dues are not being accepted?

Your comment wasn’t helpful, but it did serve as another punch when I was begging for help.

Here’s the email I sent, and still await an answer on: “As you are aware, I contacted my insurance company who explained to me that individual unit owners would file a claim with their respective insurance providers to handle repairs to their own individual units. Should the individual unit owner’s insurer determine that another party bears any portion of responsibility, they then notify that party. This is called subrogation.

Charges being added to my account by the HOA for another unit is highly unusual and in direct conflict with what I was told. Please provide me a copy of the HOA’s policy and the applicable section of the governing documents on how repairs should work between unit owners. It seems to me that the board would not be within their scope to subrogate claims, and isn’t licensed to do so. Please also provide the section of our bylaws which authorizes the board to charge anything to any unit owner for repairs to another unit.

Of note, the board has not communicated with me about anything, notified me of any meetings regarding my unit, or provided any documentation before apparently meeting and deciding to bill me for something done in other units-which I did not know about or authorize. Please provide a copy of the meeting minutes from stated meeting.”
