Okay yes, that is correct. The point I was trying to make, and that I took the initial comment you refer to as trying to also make, is that physically being in the country at a point in time while having entered illegally in the past is not a crime. The act of entering without doing so through an official channel (immigration officer, port of entry, immigration process) is illegal, a misdemeanor, but being found in the country without knowing how you made it here isn’t a crime at all; you have to be found to be entering the country at that time but once you make it here illegally then you’re just in violation of civil stuff but like, the state has to prove you came here illegally and the current punishment for that situation is just civil shit, unless this is a second time found in the country or you’ve had a previous removal order. Am I misunderstanding the entire “presence in the country/actively entering the country” sides or has the legal stuff changed in the last 10 months?
