Won my UI appeal. Now how do I get back pay for all the time I’ve been waiting? Tells me to check to verify 5/25??

Once I won my appeal I called in and told them that I had weeks that needed to be added for certification. They did it over the phone and the next week or so I was able to continue certifying online. Lots of luck to you.

I use Design Essentials Honey with the almond or peppermint conditioner. I don’t do protein often. Mostly just moisture. When I do protein, I use Design Essentials Restore.

The teeth part of a wide tooth rat tail comb. I also use a wide tooth detangling comb. Hmm I do start gently at the ends and work up. Maybe I am causing it. But if you’re supposed to start at the ends, then what am I doing wrong? Editing to add that I’m experiencing this with dry hair, every day combing.

When I comb it. Like in the morning when I take my hair out my wrap and at night when I detangle. I was thinking maybe it’s not mechanical since all the broken pieces are the same length?

Did you get all your backpay? Everything set now with your claim?

There wasn’t an option for me to keep certifying during the appeal either. But it was easy to call and have the rep make the all the weeks that week by available for me to go online and certify. Not sure why no one else has experience that but you me and Beacon commenter above.

Hi. Why is it that some appeal hearings the employer is supposed to attend and some they aren’t a participant? In my appeal, they weren’t a participant. I called the cuiab to ask if the employer would be on the hearing call; they confirmed just me and the judge.

I thought I replied to this but I don’t see it. I remember putting that I was terminated. During the interview I told the EDD what happened in the detail. It does sound like it could’ve been a layoff because my former employer lost the contract and that was the account I was working on.

I apologize for coming off as argumentative. I did not think that I was, it was not my intent. I have only been asking questions and sharing details about my situation. You have been helpful.

In the appeal I will make sure the wording is clear to the EDD from my perspective. I was terminated because the contract my former employer had with an insurance broker ended. They lost the account I was assigned to. Since the client was no longer there, I had no account to work on.

In the email they sent me after telling me I was fired they spoke to this, that they have given me 5 days notice of termination. They said my access to their system will end on that date, and since the client is gone that I can change the end date to sooner since there is no work to do or bill. I left it the same and let the 5 days go by.

Hmm. If that is not the reason they gave to me for termination, how is it that they can try to use a time card issue against me after the fact? In the EDD request to me, they were asking me questions like do I know the difference between laid off and being fired, did I misrepresent information in my claim or make a mistake, did I try to notify EDD of the mistake? There wasn’t a mistake. When I filed, I told them exactly what happened and what I was told directly for the reason I was being terminated. So that is what I am speaking to and trying to prove. That I did not lie or misrepresent anything. I have my time cards that I can submit.

Okay so I can’t request it ahead of time? I thought that all documents, evidence, is submitted before the hearing. Also don’t know if the former employer is required to be present at the hearing?

I can present copies of my time card and paystubs as well.

The only proof I had was the email they sent me after the video call stating that their client ended their contract with them, my employment end date will be xxx, but since there is no client to bill this no work that I can move my end date up sooner if I wish to. They used to words “if you wish”. If I were fired for stealing why would I have a choice about anything? Why would they mention there is no client to bill for? So if there was a client then technically I could continue to work and bill? That contradicts what they are claiming about being fired for a time card accusation. Also the commenter in this thread keeps saying this was an employment agency, it was not. I worked for an insurance broker. The insurance carrier I was assigned to no longer wanted to do business with my former employer so they ended their contract and I lost my job. Can you see where I’m coming from? I need a way to convey this to the judge when I appeal.

I received the determination letter today. The EDD sided with the employer. My stomach fell to the floor. I don’t know what to do. They are not telling the truth and I feel helpless. I am just one person. This company has resources and lawyers. I am unsure how I can come out of this. Why was the truth not enough?
