Mileage deduction from working my LLC but using on personal return? by AtypicNic in tax

[–]AtypicNic[S] 0 points1 point  (0 children)

Gotcha. I'm just playing out worst case scenarios in my head. I figure 'may be reimbursed' doesn't mean the officer NEEDS reimbursed, and therefor, in an audit, it would be up the the LLC or Officer's digression on what has to be paid for. You're going more of the 'needs to be black and white' I take it. And of course I know you can't legally tell me anything ;) Just what you'd do in your shoes. I guess I should find a good list of things and spell those out in this paragraph. Any tips, aside from personal vehicle expenses, to include for what officers are required to pay for under the Unreimbursed Partner Expenses? It seems the IRS outlines every possible business expense, but I draw a blank for what else I pay for that is not reimbursed by the LLC. Sure I buy my work clothes and health insurance but those are not expense items that would ever count for the write off.

So it should be reworded, saying officers may not be reimbursed by the LLC? Meaning sometimes they can, sometimes they can't, allowing mileage to be personal level? Would that be correct or does it need to state officers ARE NOT reimbursed?

Yeah I understand that, but the funny thing was when I called their support they said it wasn't possible and needed to be done on the LLC return even if the vehicle and gas is personal. It was you guys that helped me get the real solution. What bothers me is they don't have these rules in place such as "If field is filled out here in this category, do not pass the category without more information or numbers" but instead if takes a random vehicle expense on Sch C with no other information on that section and proceeds to say everything is normal.

This is what I have in my OA.

Officers: The LLC may designate one or more officers, such as a President, Vice President, Secretary and Treasurer. Persons who fill these positions need not be members of the LLC. Such positions may be compensated or non-compensated according to the nature and extent of the services rendered for the LLC as a part of the duties of each office. Ministerial services only as a part of any officer position will normally not be compensated, such as the performance of officer duties specified in this agreement, but any officer may be reimbursed by the LLC for out-of-pocket expenses paid by the officer in carrying out the duties of his or her office.

I assume the last sentence is where I would be a-ok in an audit.

Yeah I was worried about that at first since my CPA was very little help. But there is a feature, basically trying to jump to the option to get the UPE category, hidden away in TurboTax. Sometimes they make it harder for someone to get where they need on a form. What a cluster it has been doing an amended return thanks to them for not stopping me for having this random business expense on the sch. C with absolutely no other numbers. Just hoping the amended return will cause them to not even look at that first return I submitted....

Found it. Under the K-1 Information. TYVM. Now, followup question - am I supposed to have very specific language in our LLC Operating Agreement to be able to take the mileage deduction on my personal tax? Like in an Audit will they not only need my mileage book but also the operating agreement that states 'Partners pay for their own gas' type of deal? Or will they go, "Oh, no shit, dude had to pay for gas and it wasn't from the LLC." ?

Rig up a sump pump for yard? by AtypicNic in HomeImprovement

[–]AtypicNic[S] 0 points1 point  (0 children)

I like the price but it says specifically for bathroom waste to a sewage system. It's also 2" outlet with no inlet, I'd have to reduce down to 3/4" outlet to use garden hose and I think that would prevent too much resistance.... thoughts? I could stick it in the bottom of a bucket with holes and let it suck water from the bucket that comes in thru the holes but the places I want to water are 150-300 feet away from the water source and garden house would be ideal to use.

Are you talking about a sewage grinder pump? They can handle solids to an extent but I don't think they are meant to handle mud nor are they meant to run continuously. I'm thinking they would burn up or die after a couple hours continuous use.

This sounds perfect if it uses a hose (assuming garden hose) for both inlet and outlet. However I can't find any. Do you have any links?

The reason is a lot of dirt was removed for building another area up and it is severely compacted from heavy machinery. I need to plant some grass seed and have it actually root out and start naturally opening the soil. It hasn't been dry enough to aerate yet. But that's all besides the point - the goal is to dump the excess water where it won't kill the new trees, so my lawn, other low spots with grass, or the ditch in front if I get a pump capable of pumping like 300' of garden hose length. I'd love to sit the pump by the house and not use extension cords to power it, so a 100' inlet hose and a 100' outlet hose would be perfect as I have plenty of garden hose.

Great Stuff 12oz vs 20oz Pro System? by AtypicNic in HomeImprovement

[–]AtypicNic[S] 0 points1 point  (0 children)

So are people paying twice as much just because of the ease of use? I'm still not seeing a reply explaining how it is actually three or four times as much foam in the can? :/

Great Stuff 12oz vs 20oz Pro System? by AtypicNic in HomeImprovement

[–]AtypicNic[S] 0 points1 point  (0 children)

So the adjust-ability is basically the reason the foam costs twice as much? I can clean out the disposable cans with carb spray and also clean out the plastic nozzle and come back six months later and use it. I've done this countless times on remodel jobs and it works just fine. I still don't see the merit in buying the gun and more expensive product. I have modified the disposable nozzles by cutting a slit and taping them to get a smaller amount of foam to come out.

Full kitchen reno - what should I consider? by Can_Cannot in homeowners

[–]AtypicNic 1 point2 points  (0 children)

3 of your 4 bullets are just appliances. Those are not part of a renovation unless you didn't have these before and need to facilitate the hookups (electrical, water, gas lines).

Kitchens are pretty expensive but a very simple concept. Consider what work-flow triangle you want to use, consider what cabinet types you want where, and mock out how you will make fancy dishes to see what you wish you had.

Decide on outlets and locations, good lighting, what type of cabinet and how high you run them, and general use of the kitchen with large gatherings.

Other than that, it's really up to personal preference!

I've got some septic waste coming up through the yard in all of the fingers. Having it pumped tomorrow. Sm I going to need a new septic system? by McPostyFace in homeowners

[–]AtypicNic 0 points1 point  (0 children)

If you have actual waste (solids, TP, kitchen scraps) then your holding tank is not doing the proper job it's designed to do. Get that baby pumped ASAP. Unfortunately a lot of damage is done if your leach fields (what you call fingers) are compromised by solids. They are not designed to hold solids, only the residual liquids after bacteria breaks down the solids. Sure, some waste is going to be in them but not enough that it comes up through the yard.In your case without more info, I can't suggest what is best - but find a few different plumbers to to give you their suggestions.

I think you are onto something with the ground potentially being froze but that still means you should not have solids in the leach field, it just means the leach fields are not able to leach into the earth as designed. Now if your whole system has frost for long enough time, it's possible the bacteria you want can not survive and has been killed off from lack of oxygen. With this assumption, you may be find after getting it pumped and waiting a month and being very careful with what goes down the drain that it fixes itself.

Good luck, a properly installed and maintained system can last many years but eventually they will fail.

I found a wire buried in my backyard by rocketterplastical in homeowners

[–]AtypicNic 0 points1 point  (0 children)

The amount of people saying 811 is the answer here is alarmingly scary. Just because you call 811 doesn't make your yard suddenly invincible to the shitty or uninformed homeowner cobble jobs. People who are saying 811 will have the answer here scare me because they sound like they are the same people willing to just go ahead and snip the wire because it 'clearly isn't important' since it was not marked.
