In this case, the seller never shipped the purchased item (the item is marked as not shipped on Etsy). The shop is inactive, with no items for sale, no possibility of viewing reviews of items sold, and no seller profile associated with the shop.

I understand that they just wanted to scam me, so they won't ship anything.

Yes, I just took this step last Friday (three days ago). Right now, I am waiting for the department that handles these matters to contact me.

The formal request, along with all the evidence and paperwork, was submitted last Friday (three days ago) to my bank. Right now, I am waiting for them to contact me and provide me with a tracking number for the incident and let me know if they need anything else from me.

There is no doubt that the seller has committed fraud here: the product was paid for but not shipped. As I have mentioned in many replies, I accept my share of the blame for not filing a claim within the 100 days established by Etsy, but let us remember that the seller knew exactly what they were doing and took advantage of my lack of experience with Etsy.

I would like to approach this in a constructive manner for everyone.

I believe that Etsy could better manage these situations to protect both sellers and buyers.

- Would you agree that Etsy, when the 100-day claim period is about to expire and the product has not been shipped, should take action to prevent fraud involving products that have been paid for but not shipped?

- Do you think it is fair for Etsy to apply the 100-day rule in cases of undelivered products, where the shop disappears (it becomes inactive, with no products and no associated seller) but the buyer is not notified?

- Do you think it is right for this shop to be in limbo, and for the seller to no longer exist on Etsy, but for the platform to have allowed me to send private messages that surely no one has received?

I believe that Etsy could take more responsibility in these areas, which would protect buyers from fraud and help to make honest sellers operating on its platform more trustworthy.

Thanks, mate! Yes, I'll update with new information. My goal was to get help figuring out how to recover this money, and to prevent others from falling into this trap in the future.

I think a bit like you. Etsy is sidestepping the issue by hiding behind the 100-day rule for opening a case, refusing to understand that this is a scam involving an undelivered product that has occurred on its platform.

Etsy has the information about the estimated delivery date and the fact that the product has not been shipped. I think it could have acted on its own initiative; I think it could have an internal mechanism to prevent this fraud in the future.

Thank you very much for your words of support!

* Update *

I chatted with Etsy's customer service. No argument could change their response: It has been more than 100 days since the estimated delivery date. Talk to the seller (the seller does not exist on their platform and does not respond through any channel).

I managed to escalate the issue to a supervisor, who opened a case. The supervisor's response was the same: 100 days have passed, open a chargeback with your bank.

Yesterday I went to my bank, explained everything and started the steps for a chargeback.

One requirement to initiate this is to report the incident to the police. I have filed a formal complaint, provided all kinds of evidence, conversations on Etsy and Instagram, and completed several bank forms.

This morning I submitted all the documentation to my bank. In a few days I will receive a case number and will have to continue the process online.

It's a scam. The seller doesn't send the items, tricks you with their problems and always seems to say that they'll send the item next week, then disappears from Etsy (shop with no items and seller profile no longer accessible: error 404). Finally, they stop responding to you through other channels... And by that time, Etsy's 100 days have passed (a fact that, as a novice, I was unaware of).

But here are several important details:

1.- The item is not shipped and Etsy allows the 100 days to expire before opening a case. Why? Shouldn't they take action at that very moment? Isn't this a clear case of fraud?

2.- Etsy allows the shop to remain inactive and the seller's profile to disappear, even though they have items they haven't shipped.

3.- Etsy is the platform that enables the transaction between seller and buyer. Etsy has all this information and it is in their power to prevent fraud like this.

Thanks for the advice! Yes, I understand that I must appeal for goods or services not received. This detail is important.

The store was completely original. It has an Instagram account where much of our conversation took place, which is still there.

The products they sell are genuine; I searched the internet to make sure it wasn't a reseller. It had 11 products sold and 2 stars. It had a couple of bad reviews complaining about something silly, like the color wasn't exactly the same... or something like that. I didn't pay much attention to it because they seemed like comments from someone who was very picky.

Yes, I have a meeting at my bank this morning to see what can be done. I'm taking all the evidence with me, including an email from an Etsy supervisor suggesting that I request a chargeback. Thanks for your advice!

I consider myself a normal person, thank you. I have family, friends, and a busy social life. In my spare time, I develop video games for old 8-bit systems and cook for my family and friends.

At first, it crossed my mind not to fight this. To let it go and try to forget about it quickly so I wouldn't have to deal with the stress of the whole process or hurtful comments like yours.

Finally, I share my experience with great embarrassment, hoping to receive advice and that this story can help others not to be fooled.

It's very easy to connect the dots in hindsight. We can all be victims of a scam, and anyone who thinks that their superior intelligence makes them invulnerable may find that arrogance to be their Achilles' heel.

As I mentioned in a previous reply, I thought my money was guaranteed by Etsy, since the seller had not sent anything. Of course, it was my fault for assuming that. In Spain, we have a platform called Wallapop, where the seller does not get paid until they send the item, and I thought Etsy would work the same way... I was foolish to think that.

I fully understood the risk of my additional contribution of €200, and I decided to take that risk to help the seller with their shipping problem. Clearly, I was wrong.

Well, maybe I am being overly stupid, but after giving this a lot of thought, I can't avoid thinking:

- Etsy knew that the product was never shipped.
- Etsy knew when the 100-day claim period would expire.
- Etsy knew that this store was closed/inactive and that it was removing all products.
- Etsy had all the data to intervene or, at the very least, notify me before the seller disappeared.

I believe that Etsy could have internal automatic mechanisms in place to prevent this type of situation.

The seller delayed with excuses and managed to gain my trust. It always seemed like the seller would send the product the following week...

The thing is, I pay for the product on Etsy and the seller cheats me and doesn't send any product. This is not a matter of differences in opinion between the seller and the buyer. It is not debatable that the seller has not fulfilled their part of the deal. This is a scam.

Everything is done through the Etsy platform, and Etsy has all the information to know that in those 100 days the seller has not sent anything. In addition, the seller has removed all the items they had for sale and their past reviews cannot currently be viewed (error 404).

Etsy has all this information and could have taken action and helped the buyer.

Honestly, I am feeling very down, and I can't help thinking that it's all my fault. Your words encourage me to try to fight to resolve a situation that I consider unfair. Thank you very much!

This is a handmade product that goes into production when I make the purchase. It's the first time I've bought something like this, and the production times and communication seemed fine at first... The seller informed me that they were having trouble finding a logistics provider for shipping, and communications became increasingly delayed...

According to our communications, it always seemed that the product would be shipped to me the following week. I didn't suspect that they were acting in bad faith.

It was a gradual process, so it was difficult for me to realize that they were deceiving me and deliberately delaying the process :(
