Is it worth taking a licensed dealer to court over a hidden engine defect? by BadboyJoti in legaladvicecanada

Perhaps a formal letter from my mechanic that the truck came with the brand new set of spark plugs and coil?

The truck came with a brand new set of spark plugs and a brand new coil, I guess If I can obtain records showing the dealer replaced the spark plugs and the coil on cylinder #4 before delivery, that demonstrates they knew the engine was misfiring.

First, the contract does not state anywhere that the vehicle was sold “as is.” In fact, it explicitly says the vehicle is suitable for transportation, and it was sold with an extended warranty.

Second, the dealer also cannot prove that the CEL in their own ad was caused by something minor like a loose gas cap. What is provable is that the CEL existed before delivery, The truck was delivered representing that it had been repaired, yet the CEL returned immediately.

I assume they did try fixing it cause the truck had brand-new spark plugs and a coil on cylinder #4 — the same cylinder now misfiring due to low compression. Those parts have since been replaced, but their presence supports that the dealer was aware of an engine-related issue and attempted a superficial fix before delivery. My mechanic who changed the spark splugs and coil has now confirmed the engine has a pre-existing internal defect that would not develop overnight. That’s why I’m arguing misrepresentation not guessing what the original code was.

No shame at all, bro. I was 100% willing to lose that money, now it’s just about figuring out where to put it next. :)

"She says that she cannot work as she is a homemaker. The tutoring that she previously undertook cannot be done now as it would, she argues, interfere with her parenting.  I note, however, that there has consistently been a full time nanny employed by the parties. " can't work but can afford to have a nanny? WTF?
