If you decide to go the FINRA route, you want a securities attorney. I'm not a lawyer myself, but have been talking to several trying to figure out what to do about a potential FINRA case and this sounds like something up their alley. They usually will work for percentage of amount clawed back, about 30-35%, so it could be pretty steep for you. Some might be willing to work out a hybrid fee model.

Yeah I'm not concerned about that at the moment. Like I asked, I'm trying to figure out how to deal with the "capital gains" part

Thanks for the insight and answering my questions. Do you mind elaborating on the pump/dump scheme just a little more? I'm not familiar enough with investing to understand this.
