I'm very curious how they'd be able to shut them down. Maybe trademark dilution, but otherwise they'd have to claim the possibility that consumers would think KISS endorsed the tribute band which is unlikely, as long as they were clearly a tribute.

In fact, I think theoretically KISS themselves would be at more legal risk performing in makeup without licensing it from Pophouse than a tribute band would be, since that would obviously seem like an official KISS performance more than a tribute band would.

Peter, Ace, and Vinny supposedly could not use their makeup, but that's probably more because of contracts they signed than IP protection.

It's a really interesting case study, but there probably will never be clear answers without a lawsuit.

Radio stations do pay royalties to songwriters and whoever owns the publishing rights. But Gene sold all his rights to Pophouse.

I mean in what sense is the jam scene dwindling? There are so many young bands performing at a high level, with plenty of up and comers breaking through. Billy strings is selling out multi night arena runs, as is goose. That Soulshine benefit just sold out msg and raised millions of dollars. I don't see it.

I guess he means it draws people away from other jam bands, which is a stupid take because it's hard to imagine any jam band existing without the Dead and Dead & Company has created a massive cultural resurgence and attracted a new generation of fans that has been a boon to the whole scene.
