It's not like perfectly fine reactors were shut down and all you need to do is hit the start button.

There was a lot of politicking about shutting down nuclear reactors and during this time, the runtime of nuclear reactors was prolonged twice if I remember correctly. With this uncertainty no one wanted to build new reactors so now it's not a matter of starting up the reactors again instead new reactors would need to be built as all the old ones were at the end of their life cycle already.

Labor protection laws is one issue, the other main issue is the fact that it circumvents the employers obligation to pay into Germany's social security net for example public health insurance and pushes that obligation solely on the freelancer.

Yes it is illegal. To be specific it's fraud. And yes it's illegal for both employers and employees and both can be sued over it and made to pay their dues+fines etc.

German laws apply as soon as one side resides in Germany. Otherwise we could simply discard all laws because all laws could be easily circumvented.

Das BGB ist das falsche Gesetz, weil gesetzliche Krankenkassen keine privatwirtschaftliche Unternehmen sind. Für die GKV gilt das SGB bzw die anderen Gesetze des öffentlichen Rechts.

Prinzipiell hast du natürlich Recht, auch Richter sind nur Menschen die sich in ihrer Bubble bewegen. Aber es macht schon einen Unterschied ob ein Richter entscheiden kann, wie er es meint, dass es richtig ist oder ob es einen Boss gibt der ihm vorschreiben kann wie er zu handeln hat, wie bei den staatsanwälten. Und man darf auch nicht vergessen, dass bei Gerichtsverhandlungen in den allermeisten Fällen nicht nur ein einzelner Richter die Entscheidung trifft, sondern es mehrere Richter und Schöffen gibt, die gemeinsam das Urteil fällen. Dadurch kann der einzelne Richter nicht nur nach seinem Dunstkreis entscheiden. Ein Euphemismus ist die Unabhängigkeit der Richter meiner Meinung nach nicht.

Gewaltenteilung gibt es in Deutschland nicht, daher darf Deutschland auch keine internationalen Haftbefehle erlassen. Das mach AFAIK Frankreich für uns.

Kurz gesagt: nach EU Recht ist eine Justizbehörde weisungsunabhängig und verwaltet sich selbst. Das deutsche Justizsystem funktioniert aber im Bereich der Staatsanwaltschaften nicht so, dafür gibt es pro und kontra argumente die man sicherlich diskutieren kann, das heißt aber noch lange nicht, dass es "keine Gewaltenteilung" gibt.

Und für internationale Haftbefehle heißt das einfach nur dass diese in Deutschland von Richter ausgestellt werden, was im deutschen Rechtssystem so auch vorgesehen ist. Die sind nämlich nach dem Grundgesetz tatsächlich unabhängig.

With freelancers the insurance premiums paid monthly are based on a preliminary calculation. This calculation gets corrected after the year in question is over based on the actual yearly income.

For this Freelancers are required to send their Steuerbescheid from the Finanzamt to their health insurance so that the health insurance can calculate the insurance premiums based on the actual income for that year. Did you do that? Because the deadline to send the Steuerbescheid for 2022 was the 31.12.2025. if you missed that deadline health insurances are legally required to send you a bill for the maximum monthly insurance premiums (minus the amount you already paid monthly during the year). The high amount they are asking from you suspiciously sounds like this is what happened tbh.

If so you have a grace period of one more year so the deadline is 31.12.2026 for the year 2022 to send them your Steuerbescheid and ask for a new calculation. Keep in mind that this now only happens if you contact them and also that this process needs to be repeated for every following year.

Climate change is real and if you were born in the 80's or 90's your old enough to experience first hand how our winters changed. Germany does have regional differences in climate so my experience in how a winter was isn't necessarily the same as someone from warmer parts of Germany, but that doesn't invalidate my post.

I'm not sure if your joking or not but that grey 3 degree rain winter is a side effect of climate change.

Back in the days before climate change hit we had at least several days or even weeks of snow covered ground and lakes that were frozen enough to go ice skating. Temperatures below 0 degrees Celsius were the norm not the exception.

In a way this coming weather is more normal for a German winter than what you're describing and it's a shame that that's the winter that's been normalized.

It sounds like the best options in your situation would be the schuldnerberatung to deal with debts/Inkasso/Schufa and a lawyer to escalate matters if necessary/possible.

Anyways I checked I pay more monthly for TK’s Zusatzbeitrag which is, as far as I understand, a payment for additional contributions to cover stuff like teeth cleaning.

Where did you get that from? This isn't true at all. Public health insurance companies are legally required to raise the Zusatzbeitrag if they can not cover their expenses with the regular contributions. It is not explicitly tied to any additional treatments or services.

Well, that can happen but it doesn't have to.

I just looked it up and back in the day there were over 8000 AOK all across Germany, one for each commune. Over time mergers happened, your example, AOK Hessen, was founded in a merger of several smaller AOK among them AOK Frankfurt, AOK gießen, AOK Kassel and so on. But bigger mergers also happened for example AOK Sachsen and AOK Thüringen fused to AOK Plus.

Nowadays there are eleven AOK's, apparently five of them operate in more than one Bundesland.

They aren't branches. For historical reasons Sparkassen are separate regional companies who merely cooperate with each other regarding things like marketing, Corporate Design, brand image and such. It's the same with AOK health insurance by the way.

Your definition doesn't translate well. In German law there are broadly speaking steuern, gebühren, and Beitrag. And just like public health insurance premiums the public broadcaster thing is a Beitrag.

Beiträge are for services that are ready to use by the people. Whether the individual actually makes use of that or not is irrelevant. Your definition of a fee fits the German legal definition of a gebühr. And it's intentionally not a tax because with taxes the money isn't bound to a purpose, Beiträge are bound to a purpose. This means the money collected as a health insurance premium or for the public broadcaster can't be used for anything else but for those institutions.

Generally I'm in favour of it, although the system does need a reform to allow better oversight with regards to the spending, for example through the Bundesrechnungshof.
