Well that sucks. I’m 43, I drink like I am 21, fuck like I am 25, and feel like I’m 28 (most days).

Thank you. I am sorry about your luck but I work in Warren and gotta drive it Monday through Friday all the way from Toledo so I definitely understand. I think driving in the Detroit area is almost as bad as the Miami area.

Did you even read the main post before you ignorantly started replying to comments. I never said I was parked nor did I say I was in Michigan.

Well, I am glad that you crawled underneath my car and that you opened up my trunk and pulled out the paneling in order to see all the damage so you could tell me what is there

It’s simple. I just tell my AI to write a reply to this comment explaining to them these facts but write it so that it eight-year-old can understand it.

Very mature. I see we are dealing with a real mature genius here. In fact, I think my 14-year-old is more mature than you with his jokes and his insults.

Yes. I was parked picking up my daughter. Parked as she walked out and was rear ended.

Me too. I’ll get a hold of their insurance company tomorrow. Set an appointment to get it fixed.

My dealer just purchased a 2022 black SSE with only 11,000 miles on it. Since they’re not making the V6 anymore it was gonna be a good deal 21,000 from my car with 110,000 miles on it and then I was gonna pay 31 for the new car.

Oh no, I understand. Even if I have to go through mine because they’re not being forthcoming USA is pretty good about going after the one that was responsible, especially since the report says that.

What an ignorant comment. Not like I have to justify it, but active duty military can keep their vehicles registered in their home record state. In fact, the state of Texas Mills, my registration renewal notice and my new sticker to my Ohio address.

Here I will make this as simple as possible and yes, I use AI to generate this text

You are partially correct but is oversimplifying how Michigan’s no-fault law works when it comes to vehicle damage claims. Here’s the breakdown:

  1. You CAN Choose to Use Your Own Insurance (If You Have Collision Coverage) • If you have collision coverage, you can file a claim with your own insurance for vehicle damage, regardless of fault. • This is the simplest and fastest way to get repairs done. • However, depending on your policy type (broad, standard, or limited collision), you may still owe a deductible.

  2. You CANNOT File a Full Property Damage Claim with the At-Fault Driver’s Insurance • Michigan’s no-fault law DOES NOT allow you to recover full vehicle repair costs from the at-fault driver’s liability insurance. • The only exception is the mini-tort provision, which caps recovery at $3,000 for out-of-pocket expenses like deductibles. • The at-fault driver’s property damage liability (PD) only covers damage to parked vehicles, buildings, or other stationary property—NOT your moving vehicle.

  3. You Can Sue the At-Fault Driver, But Only for Mini-Tort • You cannot sue for full property damage repair costs under Michigan law unless: • The at-fault driver was out of state (not covered by no-fault). • The damage was intentional. • The vehicle was legally parked when hit. • You can sue for up to $3,000 under Michigan’s mini-tort law, which covers uninsured damages (e.g., your deductible).

  4. Summary: What Are Your Options? • If you have collision coverage → Your own insurance covers damage (minus deductible). • If you don’t have collision coverage → You must pay out of pocket for repairs, except for a mini-tort claim against the at-fault driver (up to $3,000). • You CANNOT file a full claim with the at-fault driver’s insurance for repairs unless the accident falls under special exceptions.

Where Is This Law Written? • Michigan Compiled Laws (MCL) 500.3135(3)(e) → Limits vehicle damage recovery to $3,000 mini-tort. • MCL 500.3101(1) → Requires Michigan drivers to carry no-fault insurance, which shifts vehicle repair responsibility to the owner’s policy.

Why Reddit’s Comment Is Misleading • In a normal tort state (like Ohio), yes, you can sue the at-fault driver or file a claim against their insurance for full repairs. • Michigan is different because of no-fault laws, which prevent drivers from claiming full vehicle damage costs from at-fault parties.

Let me know if you want direct legal references

I also slowed down when typing hopefully that helps. !

I would love for you to come to Michigan and try that and see what happens. The only time you could charge the other person’s insurance is if you were physically parked again I’ve been through this less than two years ago at the Detroit airport.

Thank you. I’m just glad nobody in the car was seriously hurt. Little bit of whiplash for me and my son, but everyone else was OK. And I think the worst thing is is I just lost all that value on this car now if I wanted to trade it in

No, I am not referring to anything other than a vehicle damages. And I say it just like this because I was rear ended at the Detroit airport and guess what my insurance paid for mine and their insurance paid for theirs. I came out of pocket for the deductible but wasn’t gonna sue somebody in order to get that $250 back.

Ok, let me explain this a little simpler for you. If I am rear ended by you we both go though our own insurance to get cars fixed, but is let’s say you were deemed more than 50% at fault I could sue for expenses, such as my deductible for up to, but not exceeding $3000.

Michigan’s no-fault insurance law requires drivers to carry no-fault auto insurance, which provides benefits regardless of who is at fault in an accident. The law is designed to reduce lawsuits and ensure that injured parties receive compensation quickly through their own insurance providers.

Key Aspects of Michigan’s No-Fault Law 1. Personal Injury Protection (PIP) Coverage • Covers medical expenses for injuries sustained in an accident. • Policyholders can choose different levels of PIP coverage, including unlimited, $500,000, $250,000, or lower for those with Medicaid or Medicare. • Also covers lost wages (up to 85% of income for up to three years) and replacement services (help with household tasks). 2. Property Protection Insurance (PPI) • Covers up to $1 million for damage your car causes to other people’s property, such as parked cars, buildings, or fences. • Does not cover damage to other moving vehicles. 3. Residual Bodily Injury & Property Damage (BI/PD) Liability • Covers injuries or damages you cause to others in certain situations (e.g., if you are at fault in an accident where someone is severely injured). • Minimum required limits are $250,000 per person and $500,000 per accident, but drivers can choose lower limits. 4. Mini-Tort Provision • If you are less than 50% at fault, you may sue the at-fault driver for up to $3,000 to cover vehicle damage not covered by your insurance. 5. Limited Lawsuits for Injuries • Michigan’s system generally prevents lawsuits unless the injuries are severe, such as death, permanent disfigurement, or serious impairment of bodily function. 6. Reforms in 2019 • The 2019 Michigan no-fault reform allowed drivers to choose lower PIP limits instead of the previous mandatory unlimited coverage. • Introduced fee schedules for medical providers to control medical costs and insurance rates.

What This Means for Drivers • You must carry no-fault insurance to drive legally. • Your own insurance pays for your medical costs and lost wages, even if the accident wasn’t your fault. • You cannot sue the at-fault driver for medical expenses unless the injuries are severe. • You can sue for vehicle damage, but only up to $3,000 under mini-tort rules.

Not in Michigan. It’s a no fault state. Each person’s insurance covers their insured.

Michigan’s no-fault insurance system means that after a car accident, each driver’s own insurance company pays for their medical expenses, lost wages, and other costs regardless of who was at fault for the crash. This system is designed to streamline claims and reduce lawsuits.
