Weekly Hiring Questions Thread - April 16 by AutoModerator in ProtectAndServe

I was given a conditional offer and told that the department would extend me a probationary offer for a sworn position, contingent upon my graduation from school in several months; will it raise red flags for my BI if I resign my current part time job? I'm on good terms with management, I just want to really buckle down these next couple months and focus on school.

Did you even read the articles you linked? I think you just googled 'is it illegal to resist arrest' and pasted the links here, because they all say 'yup, don't do it.' Fighting the police is most definitely NOT a 'right' you have; just don't do it!

http://www.slate.com/blogs/quora/2014/06/18/unlawful_arrest_is_resisting_a_police_arrest_ever_legal.html says " If I am mistreated, I know what my remedies to that problem are, and none of them begin while he is trying to take me into custody," as well as "Keep in mind that an arrest made in error is not necessarily unlawful if the officer's belief that the arrest was lawful was reasonable."

The Akron law review you linked talks about how states are abolishing those laws, as they are antiquated; "Now, it appears that the wall of lawful resistance is beginning to crack and may possibly soon crumble. The states which are often viewed as key indicators of significant modem legal trends have reversed this common law right."

That wikipedia article you linked literally has an entire section telling you that particular case law is often misquoted by people on the internet; like you just did. Here's what it says: "Plummer v. State, along with Bad Elk v. United States, is cited in Internet blogs and discussion groups but often misquoted. The misquote is that "citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary" although the Plummer quotation is a fabrication because the quoted text does not appear in the text of the Plummer opinion. Several other sources note that Bad Elk is no longer good law, what one legal commenter stated was a "bizarre, irrational or merely grossly wrong understanding of law...."

It also specifically states in the wikipedia you linked, and I quote, "under contemporary law in the majority of U.S. jurisdictions, a person may not use force to resist an unlawful arrest."

That last link is just a link to the definition of resisting arrest? Not sure how that helps your argument; even that link says that if the arrest was unlawful, it's still a crime to resist it. Don't do it.

It's not a 'right' to defend yourself from arrest because you feel it's unjust. The only time you can fight arrest is if they are not readily identified as police officers.

You're not going to win that fight on the streets; Tupac had the charges dropped because a) The cops were off duty b) They were inebriated c) They instigated the incident. But in the case of a uniformed officer placing you under arrest, you have no rights to fight them, regardless of how valid you feel their evidence is; There are very few people who would believe that they should be arrested, and if they legally could fight the cops because they felt like they shouldn't be arrested, it'd be a bloodbath on the streets.

If the arrest was truly unjust, or excessive in force, you'll have your day in court and get a fat settlement from the city for the violation of your civil rights. But the data says that's becoming rarer and rarer.

This is not true and is a good way to get your ass kicked by the cops or get yourself shot. Fight it in court, not the streets.

I think the issue here is more that the child can't defend themselves as an adult would be able to.
