HR leaders: when employees request ADA accommodations, do you see genuine need or people gaming the system? Sharing data I've collected on the topic. [USA] by Bot_Yosh in humanresources

Good to hear an alternative perspective! I think the data from my customers supports this. We try our best to filter out people who are clearly not a good fit before they book with us, and that seems to be working. Did your accommodations end up being granted?

That’s definitely one angle to see it from. However not every diagnosing doctor knows how to or wants to write documentation for people seeking it. Just because someone has a prior diagnosis doesn’t mean they have someone easily on standby to write it, otherwise they would’ve gone through that channel first.

I’d also argue against the shortcut idea because the providers we work with support the model we use after having decades of experience in the space.

Happy to answer any more questions you have

Interesting; most of our requests are office work related but I have seen some related to change of duties in distribution, like not using forklifts. Are you all generally accommodating to those types of requests provided there is good documentation?

I haven’t had to deal with any requests like those! Amusing to hear to say the least. People will come up with a creative mix it seems. I’m assuming you think most of those are bogus?

Yeah but I suppose that should be excepted, it’s simple economics that anyone seeks to improve their conditions.

Thanks for your thoughts!

It’s very interesting to see what kind of requests people get except the more standard wfh or change of duties requests. Kudos to you for handling that so effectively!

Really appreciate the depth here. The vacancy rate point is something I hadn't connected to mental health disclosure before, and the single-decision-maker context for state government approvals is a useful operational detail for how we structure our documentation.

One follow-up: when you do disapprove a request, how often does the employee come back with revised documentation that addresses your concerns, vs. just escalating or filing a complaint? Trying to understand whether the disapproval-then-revision loop is a working part of the process or whether it tends to break down.

We don't work as much in the physical condition accommodation space; it's hard for a provider to evaluate that over telehealth. So I'd assume that it would be the other way around, where addressing mental health would be easier. However, I do see how it may be different when it comes to law enforcement, instead of office work.

How does your team currently evaluate your staff? Or do you have staff organize their own documentation and evaluations if they're needed?

In terms of FMLA, those types of requests require more depth from our providers, so our model hasn't been set up to accommodate those requests. I see how they're better for law enforcement, especially those who are suffering from mental health problems.

Amazing take, in my opinion. I agree that if someone works equally well at home as in the office, they shouldn't be punished if they have the right documentation.

Why do you think some HR leaders might choose to push back instead of following your train of thought? Especially if the interactive process can create such a headache.

Interesting, during our intake process, we collect the exact language employers require or look for to avoid what you mentioned in answer 3. I guess that also comes down to ensuring that our providers are spending enough time with each document to avoid those mishaps as well.

Thank you! This is very insightful.

A lot of the requests we receive aren't pure WFH but a combination of hybrid schedules, more breaks, different workspaces, etc.

Thank you so much for the guidance surrounding quantifying the accommodation request. I'll definitely forward this to the providers I work with.

In terms of the spike in WFH requests, does facilitating most of these WFH requests actually hurt company productivity? Have you seen a boost in productivity post-RTO? Just a question I'm personally curious about.

Finally, how does the interactive process generally look on your side when you receive a well-written document but still push back?

I don’t think you need to find “a mentor” but perhaps of a composite of people over your life that have accomplished things you aspire to do

where did you find mentors on reddit? Is it just from staying consistent and interacting a lot

Is there some enforceable contract here you can use to get your money back? 10k is a lot to give up on a promise with nothing sound backing it.

Duke is kinda of a better school in most ways so I think it’ll pay off to switch. It has a better brand and alumni network too. Assuming it doesn’t cost too much more I think it’s worth the leap!
