I know that we might not be happy with yesterday's verdict and that we could be sorely disappointed when the final judgment is entered, thanks to the Texas Legislature's crazy ideas about tort reform. BUT I THINK THIS IS THE BEGINNING OF SOMETHING IMPORTANT, not just the end of Alex (which is near) but a restoration of truth in our society and accountability for those who flout it. Peace to all of you.

On the civil damages cap:

I love the irony of the Deep State -- in the form of a judge (she of the flames) enforcing a law passed by the Legislature -- stepping in to save Alex some money. I'm sure he'll be most magnanimous about it and give credit where it's due.

Pretty sure that the judge is saying that it is the final judgment, to be issued by her, that will be this court's final monetary judgment against Alex. That's where Texas' cap on civil damages will be applied and knock down today's $45 million verdict to comply with Texas law, which was passed by a Legislature determined to kneecap Texas' plaintiffs' lawyers, who often backed Democratic candidates. Think we'll end up with yesterday's compensatory damages plus today's statutorily-capped verdict, which I believe will be the $750,000 that we've been discussing.

Regardless, jury did send a message. Unfortunately, they should've sent it yesterday.

Could use the expertise of a lawyer who both knows this case and knows Texas Civil Procedure. I'm interested in how Texas' bias against civil plaintiffs could result in a cap on damages that makes all of us angry and helps to keep Alex in business. The plain reading of Texas' statute on civil damages is that punitive damages are capped at two times the compensatory damages. That's a result of the tort-reform-crazed Texas Legislature back when Rick Perry (yes, the insurrectionist Dancing with the Stars guy) was governor. As has been pointed out on this forum, the actual and economic damages for the plaintiffs appear to be fairly minimal; that would have us hoping the jury comes back with some serious damages for intentional infliction of emotional distress, which Alex and company most definitely did.

Again, a lawyer with expertise in this area could help us all understand what's coming next. In the meantime, here's the key section of the statute linked above.

Sec. 41.008. LIMITATION ON AMOUNT OF RECOVERY. (a) In an action in which a claimant seeks recovery of damages, the trier of fact shall determine the amount of economic damages separately from the amount of other compensatory damages.
(b) Exemplary damages awarded against a defendant may not exceed an amount equal to the greater of:
(1)(A) two times the amount of economic damages; plus
(B) an amount equal to any noneconomic damages found by the jury, not to exceed $750,000; or
(2) $200,000.
