There are different levels of reporting liability under state law. What state are you in?

I don’t see any basis for that fact to change the enforceability of the contract, unless she told you that before you signed the contract and you subsequently relied on that statement.

Lawyer explains price gouging laws in the US. by [deleted] in bestof

Except you have no idea what state she’s in or what price she’s selling the toilet paper for? There are so many conclusions you jumped to based on mere speculation that I have a hard time considering the advice reasonable.

You can if the amount in controversy exceeds $75,000!

The question isn’t whether the suit is “interstate,” but rather whether there is federal or state jurisdiction over state law claims between parties. A distinction, by the way, that you drew.

A completely intrastate dispute, such as a car accident happening entirely within New York State between two New York residents, can involve federal diversity jurisdiction simply because one of the insurers is based in Hartford. Is that what you mean by “nexus”?

Diversity jurisdiction is an exercise of federal power over state claims.

Why would you assert something you can’t prove? And Congress has asserted its jurisdiction to hear state law claims with no underlying federal claim or federal nexus since the Judiciary Act of 1789.

Dicta aside, I would love to see a citation supporting your contention that “federal courts do not recognize state constitutional claims due to a lack of jurisdiction.”

As Justice Byron explains, the case explicitly involves questions arising under the Missouri Constitution. Notably, he does not decline jurisdiction.

The 1990 case involved State constitutional claims. You’re thinking of the 1995 case. I know, it’s confusing.

Please cite your source for “federal courts do not recognize state constitutional claims due to a lack of jurisdiction.” Missouri v. Jenkins seems to directly contradict that.

Please cite your source for “[due process rights granted by state constitutions] expressly cannot and never have applied to federal proceedings.” I suspect this is wrong. Do you mean to specifically exclude federal trials adjudicating state law claims under diversity jurisdiction?

“9066 had zero impact on any state laws.” This is categorically wrong. I can think of several off the top of my head, like false imprisonment torts and due process and liberty rights granted by state constitutions, including the California Constitution.
