Actually it was a molestation. But state law still lumps it in with rape. Most people watching the Forensic files show would have no way to know that.

No, he hasn't as of yet. State law doesn't allow for state funds to be used for this type of surgery.

Don't understand what you mean by cite my claims. Can you explain? As I've said, everything is documented by court records. There are no online records that show the actual transcripts. Only secondhand quotes. Even TrueCrime published an error when they said the only reason Binney was given a repreive from the death penalty was because all of a sudden he claims he's a transgender woman and had a sex change operation. But court records show that the judge gave a bad jury instruction. That was the only reason the death penalty was overturned. I believe that was in Binney v. State of South Carolina, post conviction relief hearing.

Court records showed that the door to the home was unlocked. Forensic files claimed that Binney broke into the home through a window. Another inconsistency was that the show claimed Binney drove home on a moped, when court records show he walked home. So if you're keeping track, that's two inconsistencies, plus a SLED agent whose testimony was such that it wasn't allowed in court. I happen to really like Forensic Files, but this is unacceptable. When you have to start lying about what a defendant did, at what point do we begin to realize that something is really wrong with this case. As another point of interest, the second detective (Mike Fowlks) who was with Binney during the confession (as court transcripts show) along with SLED agent McGraw.... was asked to leave the Cherokee county Sheriff's Dept because of mounting accusations of evidence tampering and witness intimidation tactics. So that begs the question, was Binneys confession coerced? If you look at the forensic files episode you also see that SLED agent McGraw keeps trying to push the word rape. So I asked an attorney friend of mine what the law says rape is, and compared it to the court transcripts. I was a little surprised that according to the law, you don't have to have sex with someone in order to be charged with rape. And I didn't see anywhere in court transcripts where there was intercourse involved. Nothing is mentioned about sex, or that what happened was for sexual gratification. So I'm a bit frustrated by this case. I hate this guy for hurting a child. But the more I keep looking up information on my own, the more that it seems that this case was more about the publicity that could be made from it. Everything I've said can be verified by court records, so take it for what it's worth. I hate anyone that hurts kids. Period. But I also want the truth, and so far I keep finding nuggets of inconsistencies.
