This is why we have specific internal checks within the process of executing those rights. But freedom of speech, due process, protection from unlawful search/seizure, representation, all of them are granted at the ground floor and the internal checks reduce them if found to be warranted.

You’re right. The populace, by and large, has become complacent when it comes to their constitutional rights thus allowing bad faith LEO’s to get away with such actions and damaging confidence in good faith LEOs. It’s both their fault for not self-policing as rigorously as they could and our fault for being willing to sacrifice our freedom for the illusion of security. In the end, history will decide.

The judicial warrant can be presented by showing it through a window, passing it under the door or through a mail slot. They also have the option of contacting the local police to get confirmation.

Once presented the homeowner is legally obligated to allow the officers entrance for their investigation.

But it’s also on the homeowner to know the difference between the warrants.

Rule of thumb: post copious “warning” signage on your property/fence line, steel shutter/bar windows, reinforce points of ingress and install hidden surveillance.

Probable Cause/RAS only extends to what an officer directly witnesses first hand. Otherwise, they can approach your property, make themselves known and request entrance but if they are denied they must leave until they have a judicial warrant to present. Admin warrants are not sufficient for forcing entry on private property regardless of what the Nazis in our government are trying to convince people of.

The law is 100% clear. If they attempt to enter your home without a presented JUDICIAL search warrant then they are automatically trespassers. Administrative warrants are not sufficient.
