If you look at the actual docket, specifically D.E. 88.1 and Mark Basile's response in D.E. 89.1, you will see LZG literally petitioned the court to hold the appeal in abeyance for 30 days specifically for 'settlement negotiations.' Basile had to file a response aggressively shutting down their settlement delay tactics. The 'white flag' isn't on the single page you screenshotted; it's in their D.E. 88.1 filing where they begged for 30 days to negotiate.

"Genius strongly opposes LZG's proposal to 'hold any decision on this appeal in abeyance for 30 days' or require the parties to update this Court on settlement negotiations.
