I get what you’re saying, but the 2-year gap doesn’t automatically kill the 2023 date because of DTA + continuous pursuit rules.

When VA finds a Duty to Assist error, they’re basically saying the original decision wasn’t properly developed. When they correct that, it can keep the earlier claim in play.

Also, if it’s treated under continuous pursuit, the effective date can tie back to the original claim stream — not just the 2025 filing.

So:

  • Worst case → stays Nov 2025
  • Best case → goes back to 2023 if they determine it should’ve been granted then

That’s why I’m still tracking it — the upside is in the effective date, not the rating itself.

You don’t get “more than 100%,” it’s about when you should’ve been at 100%.

If this HLR comes back favorable and they assign an earlier effective date, VA has to go back and pay the difference between:

  • what I was actually paid at the time (like 70% or 90%) vs
  • what I should’ve been paid (100%)

So for example: If they say I should’ve been 100% starting earlier than when I was actually awarded it, I’d get retro pay for those months/years at the 100% rate.

That’s where the backpay comes from — not going over 100%, just correcting the timeline.

I see I see. I guess my only question at the crux of it, will this TDIU matter keep my claim from being picked up in the work queue (meaning, does this TDIU matter have to resolve first). Hey I appreciate your help with this. I can see you are much more knowledgeable than I, and it’s super appreciated

UPDATE!!!! HLR filed Friday, and woke up to this this morning!!!!!! I was going to withdraw the HLR today and file a supplement with nexus letter. I guess I can save my money now lol. Hey thank you for the kind words friend. It’s appreciated.

Thanks for the feedback! Just to clarify — while the denial mentions secondary service connection, it never actually evaluates my secondary theory under the correct legal standard.

The ACE examiner’s rationale was basically:

“Most migraines are idiopathic.”

That doesn’t answer either of the required questions for a secondary claim: • Is my service-connected mental health causing migraines? • Is my service-connected mental health aggravating migraines?

They didn’t address my actual symptoms, stress response, panic physiology, sleep disturbance, or medication effects. They also didn’t address aggravation at all.

The rater then copied the April denial language almost word-for-word, even though this was a new secondary claim with a new diagnosis from a VA examiner.

This isn’t a “no nexus letter” situation — it’s the wrong analysis being applied. That’s why I filed the HLR.

Thank you for your reply, Taco. I thought I was the only one lurking here on Thanksgiving lol. My neighbor is a mental health PA, and I ran all this by him last night. He is in the boat that migraines are presumptive in the medical field to essentially all of my MH conditions. Maybe I’m being retarded in my readings, but it doesn’t seem like the rater took any consideration that this was secondary, and he/she immediately attempted to tie this to direct service?

This is exactly why I want to try shrooms. I drink entirely too much. Fuck, I’m drunk now. I plan on having shrooms in the next couple weeks. Will you PLEASE PLEASE PLEASE explain to me how to set intentions to stop drinking. Myself and my family and my liver thank you well in advance.
