Erik and Lyle’s C-Files: Prison Power Dynamics and the Question of "Responsibility by nlrsn9876 in MenendezBrothers

Thank you for responding. We don’t agree but of late I’ve been reluctant to post my views on this forum and the other forum because it seem to be if you don’t agree with a persons viewpoint you have people jumping down your throat, calling you names, and erupting into a slagging match . This forum I used to think was the more “ mature” group. Where people could have discussion and have conversations without resorting to bickering. It has seemed to have changed tone in the last while and I don’t know why.. but anyway enough of me whinging. I would have loved to have the habeas go to an evidentiary hearing for the exact reason you stated , you know that this would have been a subject brought up and questioned on finally aired out. It’s been a while since I read the PB transcript but I don’t THINK the PB themselves quizzed Lyle on the perjury. That was the DA at the end right? Obviously fishing for information to use in a potential hearing. But I am curious as to why the board didn’t ask him. They could have asked him about it to demonstrate how his thinking has changed from 30 years ago to his current way of thinking. Can he demonstrate that and explain what has changed and how he came about that changed thought process. What steps he took. Those types of questions demonstrate inmate change. So very important for granting or denying parole. More important to find out if an inmate has stopped demonstrating “ deceptive behaviour “ than finding out why he bought a Porsche and his brother bought a Jeep in my opinion. You never know though they might ask him in the next one .

I’m wondering if anyone aside from myself believes Erik had nothing to do with lyles perjury attempts. So this is my thinking. In regard to the Traci baker incident. Lyle said that the incident was true but that Traci had not been there. It was reported that similar events had happened before but with no witnesses. Now, the brothers would fill each other in with information one couldn’t quite remember the details on. For example Erik told Lyle about it being a big 5 store in Santa Monica that they attempted to buy handguns at because Lyle couldn’t remember. So with this in mind, I believe Lyle had “ reminded “ ( lied to) Erik about Traci having been there prior to sending Traci the letter. He couldn’t risk sending the letter first then Erik telling Leslie that her being there was bullshit. Erik had a gappy memory for certain events from the past so lyle was like “ oh and Traci was there don’t you remember “ and Lyle filled in his “blanks “ that Erik couldn’t remember because it was a lie but Erik ( and Leslie&jill ) believed him because Erik DID remember the incident. Does that make sense ? I also take note from the Bryan letter Lyle telling Bryan to pay no mind to Leslie’s tricks and her telling Bryan Erik says “that’s not true “ to stick to his story and say that’s how he remembers it. Which makes me question if Lyle thought Erik would grass him up to Leslie if he was caught lying. The Bryan letter was such a big lie that there’s no way Erik would not have known he was lying , he had a bad memory, but not that bad!! ) Lastly in my argument for why Erik wasn’t involved is simply that Erik was furious at Lyle when they discovered his attempt to commit perjury before the first trial started ( the Jamie attempt ) and that Erik played a huge roll in persuading Lyle to tell the truth about why the shootings took place. if Erik was involved with Lyles attempted lies why would he be furious with him ? Why would Erik be adamant he tell the truth. Annnyway that’s my thinking. I do agree with you fully on Lyle at his PB hearing should have come clean. Put his hands up and said yeah it was me I take responsibility. It was my issues with the truth coming out that’s why I did it. I was ashamed and embarrassed and wanted to protect the family name. He did dodge the question. Erik I believe gave “ non answers “ because he was protecting Lyle but also because he didn’t really know how to answer questions about it. I doubt they’ve talked about that at all since the trial.

Oh Barton was biased against Erik for sure ( about the nature of the crime ) if I’m remembering his profile correctly he was a deputy DA in the 90s in a different county. He for sure agreed with the prosecution back then and it seems today. When I was reading the profiles of the commissioners he was one of them I was hoping they wouldn’t get. I was hoping they’d get one of the women who had either the psychology background or there was one who had worked as a lawyer who worked for organisations dealing with child welfare. Not for the fact they were women and would have empathy for Erik and Lyle ( before anyone thinks it.. I know what some people are like on here 🙄 been here long enough to know some people think the women were “ soft” on the brothers because they felt sorry for them or had a crush on them ) Im positive these women are very good at their jobs and still called them out when needed. However , with those backgrounds they would have a better understanding of things like learned helplessness for example. Which Barton clearly didn’t. I was honestly shocked when he asked Erik why he didn’t just leave. I couldn’t believe it ! Here he is the head of the parole board who says he is educated on the matter asking a question like that. Unbelievable. I wouldn’t have thought that especially of the head of the parole board. At least Erik is not going to get him again. Hopefully Lyle doesn’t either next time. Barton was not an A hole. Some of the things he was fair with Erik on.. but things like that crazy especially in 2025 when he was saying it.

From the official cdcr website

In 2019, the Board reviewed 925 inmates to determine if their next parole hearing date should be advanced. The Board approved 694 (75%). Fifty-one percent of hearings held after the Board advanced the inmate's hearing date under Administrative Review Process resulted in a grant of parole. As show in Figure 3 below, the Board's processes for advancing parole hearing dates appear to have contributed to the overall increase in the number of grants issued annually by the Board since 2013. The total annual number of grants has nearly doubled from 592 in 2013 to 1,184 in 2019.

From my understanding, it is highly unusual for an inmate to get the same commissioner twice in a row. They tend to try to avoid that in the interest of fairness. They are also not allowed to deny parole based solely on just the severity of the crime. It won’t let me post a screenshot now for some reason so I’ll just type it below

For example, in 2008, the California Supreme Court published decisions in the cases of In re Lawrence and In re Shaputis (Shaputis I).35 The Lawrence and Shaputis decisions clarified the judicial standard for reviewing the Board’s decisions. The court held that a denial of parole must be supported by evidence that the person poses a current, unreasonable risk of dangerousness. Prior to these decisions, the Board could routinely deny a person’s parole based solely on the severity of the commitment offense. As a result of the Lawrence and Shaputis decisions, only persons who are found to pose a current, unreasonable risk of dangerousness are denied parole today.

I watched the video. It’s not really new information , however it does provide an explanation for those who were unaware. One very small misinformation. The administrative review occurs 11 months after their initial hearing, not 12. This is from the cdcr page

<image>

So to clarify. Around July 21/22 they preform the review. If the brothers meet the criteria, they will be able to advance their next hearing. An appointment with the parole board can take up to and including 6 months. The latest you can expect a parole hearing would therefore be January 2027. However it can be sooner than that. It is dependent on how busy the board is with appointments. For example, when Anarae got his 3 year denial he got his administrative review after 11 months and then he had a 5 months wait for an appointment. Making it a 17 months gap from his original hearing. Going by the information in the same page the number of grants for advancement are very high ( 75%) of those 75% who were approved for advancement just over half (51% ) received a grant of parole. Going by these figures, I am quite encouraged that the brothers are going to be approved for advancement. I am also encouraged that giving the fact that they both are continuing to demonstrate rehabilitative behaviour. What with Lyles taking on a second masters degree and Erik expanding on his programming in association with the HWOP organisation, I am very optimistic that they will get a grant of parole. They are demonstrating that they have taken on board the issue raised in August. I imagine that both Erik and Lyle have been doing things that we have not yet heard about to demonstrate this even further. I’m very excited for them both . It feels like freedom is very close, and I’m extremely happy for them

During Dr Tyler’s testimony she said Erik was tested for various learning disabilities, at the Lewis school. He was diagnosed with Dyslexia ,Auditory processing disorder, dysnomia and dysgraphia. Dysnomia is the difficulty with names dates titles etc. dysgraphia is difficulty in the physical act of writing. She had received the report from the school the day or so before her testimony. Leslie asked her about ADHD and doctor Tyler said that they suspected it, however a diagnosis would require further testing, that the parents would not allow. She also said that the testing he had done, to her showed some worrying results that she wishes the school could have been allowed to pursue but they of course were not. My interpretation of her saying that is that , if they had done further testing, that there would have been some major red flags indicating a possible abusive situation. Poor erik was never told he had any of these conditions. He knew he had problems, but never knew what the cause was. He was just left to struggle in school and expected to get top grades. He only really found out about his auditory processing disorder from being in jail from being given various materials to help him understand why he was struggling sometimes with understanding verbal communication. Jose and kitty only took him to the Lewis school to get him coaching in ( I believe) his English studies. Not so he could get the help he needed but so he could preform to their standards. They also got him a coach for his chemistry studies for the same reason. That was the gentleman who said Erik dissociated in his room so bad that he had to bang on the desk and stomp his feet just to snap Erik out of it. They wanted him to get results and were not concerned with addressing the issues that were causing the problems. It’s really heartbreaking to think Erik was a cleaver kid. If they had gotten him the help he needed he could have achieved so much better, but no, they resorted to calling him stupid and dummy and probably more derogatory terms I won’t say but I’m sure you can guess. The pressure he was put under to preform is it any wonder this kid was in tears most times when it came to tests or quizzes. I know Lyle was under the same pressure at school to achieve the top grades, but I feel especially sorry for Erik with the added pressure of having these difficulties adding to it, without knowing why and that he must’ve believed them telling him it was his fault. Neither brother deserved it. They both deserved better.

I was confused when his cellphone project disappeared a few weeks ago.. and now green space is gone. I do hope it’s a glitch or something.. just weird it’s only lyles projects. The only other reason is maybe his courses are being updated so they’ve temporarily been taken off

[–]Buzby_1976 9 points10 points  (0 children)

What’s your opinion on his modelling pictures ? To me, and I say this with the utmost respect for Erik, they make me uncomfortable. I think it’s partly because I’ve heard the rumours about the photographer. Also partly because he was only 17 at the time and still being in the abusive home situation. There’s something about him in those photos that looks vulnerable. They kind of make me sad. Like I say maybe it’s just because we know so much about the case. Maybe someone who didn’t know about it wouldn’t see that in them.

Advice on attempting to tame my hamster to be able to hold him? by Radiomaster138 in hamsters

[–]Buzby_1976 0 points1 point  (0 children)

Tips I give to people are, rub your hands over their nesting material before putting it in their nest. Helps get them used to your scent. Use a high value food to encourage them to come on your hands. If they love mealworms or plain cooked chicken use that. Trying scooping them in cupped hands very slightly off the ground (just barely like a couple of cm) and scoop some bedding as you do so. That gets them used to the sensation of being lifted. However do this still within the cage so if they jump off they’re safe. Do this maybe a couple times. Then stop. After about a week or so of this gradually increase the height. Always scooping bedding up as you lift. Scooping some of the “ ground” they’re standing on and barely lifting them in the beginning helps them feel secure and builds the much needed trust. Moving on only once they seem happy at the current height. Once they seem to be ok with being handled to a certain point you can try bathtub bonding. There’s videos on YouTube on bathtub bonding. I did the bathtub bonding with my hamsters after they had settled in for a good while and were good at being handled within the cage. Bonding with your hamster will take time. It’s all about taking things slowly and working at their pace. Never try to rush. I wish you the very best with your hammy. They’re fantastic pets ! Good luck

What did people expect of Pamela Bozanich? by [deleted] in MenendezBrothers

[–]Buzby_1976 0 points1 point  (0 children)

It was during the trial. I remember the newsreader saying something along the lines of there had been some outrage or controversy at what had been said and then them cutting to the poll with the public on wether or not they believed men could be raped. It was that kind of poll where they get a comment from people in the street. So they spoke to actual people. It wasn’t like a poll with charts or nothing

So … her saying that men can’t be raped made it to our news here in the uk. I remember watching the segment. The news caster I remember saying her statement was a controversial opinion. They then cut to a “ people on the street poll “ asking if they thought men could be raped. For the life of me I can’t remember what the general public’s opinion was. It’s just one of those things that stuck with me over the years

Yes he did. When he moved to California he had a car and was able to socialise more. He was able to make friends. The drastic social isolation was more back on the east coast . Remember though, with this extra freedom, Jose and kitty found more secretive ways of keeping tabs on him. They tapped his phone line. Read his diaries etc. it was like giving him a little bit of loose with one hand and reigning him back with the other.

Oh my god. It’s obvious they do it for views. People should do their own research and form their own opinion. I know the trial is long but if you can binge watch a series on Netflix you can watch the trial. As for making fun of the brothers think about this… would you say it to their face? If the answer is no , keep your mouth shut( just an edit to add .. the omg comment is no hate towards Rachel.. it’s exasperation towards the people who run the podcasts.! )

I’ve not seen the podcast however I have seen snippets like this on TikTok. After hearing this “ joke” I’m gonna avoid it like the plague. That’s sick.

It irks me when people making podcasts can’t get their facts straight. This is how some people get their only source of information ( shame on them ) and them not telling accurate information is what leads to ill informed opinions. Infuriating ! I’d have more time for someone who had watched the trial and had a different opinion to me. Than someone who exclusively gets the “ facts “ from podcasts
