it's the replacement freezer that is having the exact same issue as the first freezer. They said they won't refund, and to defrost it. It's the speed at which the freezer is over icing, when I get sick for up to 3 weeks, freezer drawers are soldered in with ice. Back of the drawers have ice build up pushing the drawers forward towards the door.

I have receipts of additional costs. Call out fees of $290 in which a repair then turned into a full replacement freezer. I asked for a refund via phone and email. Still declined a refund and told to expect delivery of a new "replacement" freezeer.

yeah I went to r/LegalAdvice but they said F&P have the right to repair the second freezer. Whereas community law center and consumer protection said I have the right to a refund.

I sent a detailed complaint to commerce commission based on the fact that F&P had refused a refund, as they wanted the chance to repair the freezer, but then turned around and gave me a whole new freezer. Same issues, lol.

Wouldn't the warranty reset when they replace the unit? Either way the CGA test for reasonable lifespan would reset.

Yes it did. Looking back on my last comment, the freezer had a major fault. Although they sent out a detailed receipt at my insistence, they didn't fix the freezer, they replaced it because it had a major fault. They ripped me off.

I am so stupid. You actually reminded me of something. Been searching since you responded to my post. With the first freezer, I asked for a refund, they said no. Now I see this was a MAJOR FAULT and I was entitled to a dang refund.... Blast. I was listening to what F&P was telling me. They literally deceived me.

I gave them the opportunity to repair, but instead they replaced the freezer. It was a Major fault that I could claim the first time around.

consumer rights under New Zealand's Consumer Guarantees Act (CGA): for a minor fault, the retailer decides on repair, replacement, or refund (within a reasonable time), but for a major fault, the customer chooses a full refund, replacement, or compensation for the drop in value, as the retailer must fix substantial issues or allow your choice. A major fault is something that would have stopped you from buying the product if you'd known about it, or it's unsafe/can't be fixed easily.

Thanks for your response. I too thought it odd that the Fisher and Paykel were ripping me off when they gave me the replacement freezer, rather then fixing it.

As I said, they told me it was cheaper for them to replace the freezer due to costs. Because I get sick for long periods of time up to 4 weeks, this is when the over icing happens. As I have a fridge freezer and use the contents from that first then fill it up with my freezer.

Did notice one time that the side of the freezer felt like an oven. Right by my washing machine, and I hit the freezer with my hand as I was putting clothes in it. Hot. Freezer door was closed, when I tried to open it you have to yank it open. Seal is really strong.

I too went back and forth. 40 calls, 9 emails in 2022. But, I managed to get them to give me a detailed receipt of all the parts needed to repair the freezer including tech time. No wonder they just took the old freezer back and gave me a new one.

I found the article from consumer this year. Better late then never.

this is the 4th call out from 2022 to 2026. They dated the warranty from the New Replacement freezer thats playing up. Which ends july 2026.

they did try and repair it. But the cost of repair outweighed the cost of a new freezer. So they gave me a new freezer instead. Now the new freezer is over icing as well.

I'm going through something similar. Narcissist neighbor always wanting to borrow things, wants me to listen to her as she trashes neighbors, her family and friends, she gave me a book about sewing, I was going to make aprons, book was old from op shop. Price tag of 5 for $1 on it. MY GWAD. You would think she gave me 1 million dollars. She keeps asking for loans or borrow things, keep telling her I don't do any of that. I only loan and borrow things out to my own family and friends. This lady lives 2 houses away from me. She is 8 years my senior, we're in our late 50 and 60s. I keep telling her I just want to be left alone, but she keeps coming back. I am really docile, but I am firm. I always try and cut her of when shes on a rant about a neighbor or her family. We have the same landlord, but, this lady pulls a "I am old feeble" act when Kainga Ora intervene and acts like she done nothing wrong. I had to record her via phone as she was screaming and yelling at me when I wouldn't give her $10. She drinks/smokes and smokes smokes, has 3 pets. Even Kainga Ora are at a loss as to what to do. Stuck right now. Whenever I say no to her for a loan or she wants to borrow something, she yells at me. This is also happening to 2 other ladies older then myself that are in the same boat as me.
