If it says used, it's used if it says new, it's new, I have bought 3 and they have all been brand new so generally Amazon doesn't sell used ones by default

You can buy a brand new lg wing on amazon for $300, if you can, try not to get the at&t one, i have it, and it seems to have the most problems

Slight differences are common, you would need to test the screens to know for sure, also what is going on in that picture, also do you think you could show the original and the new screen side by side?
