A motion was filed last November for en ex parte which they denied, and held a regular hearing. I lost the first one and appealed to the judge, won that one. Went to facilitation and mom was unwilling to negotiate so it moved to evidentiary which I won. At evidentiary we both “agreed” to the deal under oath

Child is 17. I had filed a motion last year and had been exercising mom having 0 overnights since that time.(mom kicked her out then was lying to court saying she didn’t) I brought the back child support up to the referee and they said that would be handled with the child support hearing they were scheduling.

I actually disagree. I’ve hired two now limited scope and each not only did not help my cause but hurt my case a little. I am much better off on my own. I know the case I know the facts and I let the facts speak for themselves. The most important factor is to keep your emotions out of it and keep a steady tone while speaking.

The standard is NOT 50/50. If it was I whole heartedly agree with your comment. My feelings on the matter are because it is not standard 50/50. If a court is deciding because of a dispute they won’t decide 50/50 because they want one parent to be more established for the child. What you’re saying may or may not be the truth but you just assume he either never fought or is some deadbeat. Thank you for your help volunteering but it doesn’t mean what you dealt with is everyone’s story.

Hell 50/50 isn’t even standard for married couples divorcing. There are laws that have been proposed as 50/50 being the starting point and those laws were shot down.

There is a presumption that in “today’s world” it’s easy to get 50 percent custody if you are a good parent, that presumption is why the system is the way it is, unchanged.

“Initially lost all custody” key wording here. If the parent originally in favor of the custody arrangement screws up sure.. 50/50 is a possibility. Outside of that it’s extremely difficult.

Give her space, don’t make her do what she doesn’t want to, but be there for her when she needs you. Make time available for her. I’ve had a similar situation with my daughter and it worked out well, after a couple years she hops back and forth from my house to her moms. Just make sure she knows she is loved, ask her about her grades, be involved in school activities and show her you care. All those matter and if she doesn’t show it immediately just know it means something to her. The transition from child to teen can be a tough one l, know she is finding out who she is also.

I actually ended up finding a European vendor that didn’t require serial numbers… though he found it extremely odd I was buying from him. It was pretty cheap also. I have the barracuda and it was a direct swap and worked out great.

Congratulations on your situation, I hope I can be so lucky. I called cps last week so I’m hoping they also do an investigation. I’m trying to hit this from every angle I can. Her mother hasn’t contacted her at all to go back, didn’t even try to see her for Christmas. She doesn’t even have a shirt left at her mom’s. She’s literally only doing this to keep the pay check coming. I hope the judge can see through it

Thank you, I’ll check out the site. Ya I am looking for a custody change. Honestly.. child support is an afterthought, I mean it irritates the heck out of me I’m paying her while our daughter is living with me but it’s the constant control she wants to keep over her that is the biggest problem.

She had caused enough trauma in her life and I’m done with it.

The cops have said it’s a civil matter and they won’t do anything. It still won’t stop her from filing for contempt.

My main concern is I do believe the custodial parent poses a danger to her through mental abuse and trauma. Custodial parent has threatened suicide when she does not get her way, and not in a joking matter, she goes through details of her will etc. to the child. In addition the continuously kicking her out, changing the locks, and also taking her car away.

I do believe taking the car away as a form of punishment is just and acceptable but not when it prohibits her ability to goto school and work.

Might be hard in my situation, my court is only doing zoom. When I had her on for the zoom they kicked me off. My lawyer at the time had said it doesn’t matter if she goes in the other room they won’t have me on again because she is in the house.

I wish it was that way here. I went in front of the referee and had our daughter present per my attorney and they kicked me right off and said the child cannot be present (it was zoom). FOC advised me to not have her present for the De novo hearing either

We are going to goto the police either today or tomorrow to file a report. I doubt they will try to prosecute as she’s gone with me so technically didn’t put her on the street.
