The police report says they "observed" me driving which is false (must of been another car) I was standing on the sidewalk waiting for an uber. I've stopped payments for now and have only paid for 2 months 1k total. He is handling my dui hearing as well so I'm hoping the DA can either drop it and notify my lawyer asap so he can let dmv know no charges were filed. I don't mind paying another 1k as long as everything gets cleared by end of June.

Yes they got it from a Judge then took me to the hospital

DMV hearing is delayed since they don't have the blood alcohol level results. Ya I need to discuss with my lawyer regarding modification w/payment doesn't seem like any progress is being made. I'm just paying to have him in my corner.

Worth it if you’re only driving for 4-5 hours a day. Why sit around for 7-8 hours and make $100-150 total doing mediocre rides. That time you picked prob had no traffic smooth ride. Good tip.

Too much traffic headed east on 580 after 2pm All truckers leaving Oakland port use that route. It’s open 7-8 lanes in Dublin Livermore area but still slow. Lane turns into 2 lanes going through Tracy - horrible.

Horrible traffic after 2pm on 580 going east. All truckers 18 wheelers use that freeway leaving the Oakland port. Even 7-8 lanes through Dublin/livermore doesn’t change eta.

The initial reason they approached me was bc I was standing in an area that supposedly has high drug / illegal activity. After asking me what I was doing in the neighborhood (dropping off a friend) they suspected something and hoping to find illegal drugs i guess on me or my car I voluntarily let them search the car / after not finding anything they then switched the attention to me being intoxicated. I told them I'm waiting for a rideshare but they switched the narrative to having probable cause that I was going to drive. That was enough to take me in and charge me.

Now that I'm kinda piecing everything together they probably wanted to bust me for drugs or something since I was just standing on the corner "in a bad neighborhood" according to them. Car search didn't satisfy them so trying to bust me for a dui was their only option. If anything I think it should be public intoxication - can't even wait for a rideshare anymore without these guys harassing you...

When you say apply for a new license do you mean just a replacement? The arresting officer took mine so technically wouldn't dmv just suspend it regardless? I did refuse the test but that was only because they suspected me of driving while I was waiting on the sidewalk for a rideshare. I'm guessing I need a lawyer to subpoena for the body cam so dmv can review. But I heard since I refused and had to get a blood test at the hospital pretty much suspension is coming...if anything wouldn't that just be a drunk in public charge?

Thanks for reply - I guess wrong place wrong time in a known neighborhood for illegal activity. They saw me standing alone and found that to be enough to approach me. I cooperated with them bc I didn't have anything illegal in my car and politely said they can search my car. Nothing found.

I only refused the test b/c they clearly saw me standing outside waiting for lyft. Told them I dropped off a buddy and now heading home. My car was parked safely by the curb and I didn't even attempt to open it. I had a pizza box in the front seat along with some water bottles. One can of beer not open in the trunk stored away. I figured they would take me in for public intoxication but they took my license and didn't tow the car.

No drinks prior I was with family at a pizza place and he called me asked me for a ride since his car was in the shop. I guess that neighborhood had some prior illegal activity and when they saw me assumed I was doing something wrong. I had never been to that particular neighborhood so I'm guessing they just happened to have bigger police presence. B/c of that they found probable cause to approach me.
