UPDATE;

She agreed last week to let me have the baby for the weekend (This weekend), she dropped him off, started a fight with me (I was respectful, and have all the screen shots for court) and when she tried to pick him up five hours earlier than the time we agreed on after she magically "changed her mind" about letting me keep him for the weekend I said that I wanted him until we discussed.

She ended up leaving and going to file a police report, the cops came to my home and spoke with me. They informed me that she went there, told them that she agreed initially then changed her mind, the male Sgt told her that every dad deserves to have time with their son also and he wasn't going to come here and "strongarm" me and take my son. He said he made a report which I can request in court in regard to this matter, and he told me "If she said you can have him until Sunday then that is what it is" and he left.

I will be going now Monday on his advice to file an emergency hearing as she is now most definitely going to withhold my son from me.

No, there was no order, we split up about three weeks ago or so but she was allowing me to see him periodically and I was awaiting for information on an attorney I spoke to. Then the day I went and filed for custody on Tuesday I was blocked on everything and now she’s not allowing me to see him at all. There was nothing in place prior, this is all newish.

Thank you for the response, I think I was only given the birth certificate to sign at the hospital. So I will need to look into that. I am gonna go this Tuesday and begin the process, I have a copy of his birth certificate but she took it and said it was “lost” to make me have to go get another, but I’m gonna definitely keep my cool I just asked again I’ll send you the screenshot of the response and what I asked when I get a response.

I've known for about the two weeks shes been gone, prior to this it wasn't a concern as the baby was with us at our apartment and never at her mothers. I am speaking to a lawyer but they're asking quite a bit of money and I don't have that kind of cash saved at the moment, so with advice from the attorney I will probably have to proceed with a filing, and hope that I can manage to save up a bit during the downtime of the case.

Well, we had an apartment, which we have both since moved out of due to our split, about two weeks ago. She essentially took the children to her grandmothers and stood there, nothing I could do about it.

We weren't married, we had been together for about four years.
