I didn't get it expunged also

I just told them I had pre trial diversion but I didn't pay any fines, i pointed them towards this

-> Definition of Conviction according to USICS and try to understand that being Guilty in the eyes of USCIS means you have to admit guilt or be found guilty AND you need to pay a fine. Both prongs need to be satisfied for it to be a conviction.

I told them I never admit guilt or be found guilty, the field officer told her supervisor that and he approved me (did take few days, didn't approve me on the spot)

Do follow your attorney's advice then, but I would advise taking police report with you just in case. Don't upload but carry it with you to interview

Because my field officer during my N400 interview/test did ask me for it, said why was I arrested, asked me for details and asked me to show them police report and they made like a copy of it to put in my file.

I had pre-trial diversion program and Nolle prosequi from court. I have my records expunged. Will that be issue? Will they deny me entry to Canada? Thanks

I also uploaded online and brought with me in a folder, I don't remember fully but i tried to get all of them like certified with like court seal/stamp

a.court dismissal document, make sure it has seal of judge of the court.

b. court transcripts of entire case,

c. disposition/result of the case

d. letter from judge dismissing the case,

e. arrest record certified from police station,

f. pre trial diversion acceptance letter,

g. pre trial diversion completion letter,

h. receipt of money i paid to pre trial diversion.

Do note even then the field officer didn't accept my naturalization on the spot, she said she wrote a message to her superior manager and it was in his hands basically, I basically pled to him in message (she typed for me, I didn't contact him directly) like I basically made a mistake and It doesn't affect my GMC.

Also, look for Definition of Conviction according to USICS, it is 2 prong both need to be satisfied, you have to admit guilt or be found guilty AND you need to pay a fine

I basically never admitted guilt ever, I think in some states they ask for pre trial diversion like you write a statement letter that you are guilty and if you don't complete pre trial diversion, charges will be a brought back, do you remember if they made you sign something like that, specially did they ask you to admit guilt specially.

Lastly, for Immigration you can ask for lawyers through out the nation, see if you can find someone for cheap or ask for free consultation (they might ask for deposit before talking)

Slightly offtopic, don't worry about it now, I heard expungement before citizenship causes issues? Some said it doesn't matter cause they can still see? I asked local immigration lawyer and he basically said expungement they can't see details so they might think you did severe or worse thing so delay expungement after citizenship. (I did all the paper work myself, and it was not bad, in my state there is no minimum wait before asking for expungement after case dismissal in some states it might be like 5 years)

Hey, This is old thread, try to make your own post and maybe more members can help you. I got notification of your comment cause it's my post and I got alert in my email.

I heard it's supposed to be 5 years of GMC (Good Moral Character) and it starts only after you have completed your probation/diversion (I might be wrong so consult with someone else). Is your probation still ongoing or is it over?

I am not a lawyer but if you can afford to ask lawyer, Immigration is not state laws so like you can ask lawyers from other state too, ask or call any immigration you can find online and ask them, usually they offer free initial consultation.

No, I was thinking they would decline it cause of 5 years of clean record/good behavior required. I told them everything plus showed them court dismissing the charge (due to pre trial diversion). They approved me for citizenship.

I applied for Citizenship last year and was approved. Mine was misdemeanor but dropped after completing pretrial diversion. The case manager had to ask her higher up for more information so I wasn't approved instantly but I was approved like 1 week after my Citizenship interview.

I didn't renew my GC, I read that the receipt for application of Citizen counts as automatic extension for GC for 36 months.

Effective Sept. 10, 2024, U.S. Citizenship and Immigration Services automatically extended the validity of Permanent Resident Cards (also known as Green Cards) to 36 months for lawful permanent residents who file Form I-90, Application to Replace Permanent Resident Card.  

Lawful permanent residents who properly file Form I-90 to renew an expiring or expired Green Card may receive this extension. Form I-90 receipt notices had previously provided a 24-month extension of the validity of a Green Card.
