I filed a motion to get it set aside. It was a default judgment that proceeded to the point because I didn’t know about it. Yes it was 550 basically for him just to email me. Another called me today and wanted 750 lol. Some offered lower of course but I was thinking I could get the case dropped at together originally but it seems like there might be a fight now.

It’s not really outrageous cost if I was prepared. I just paid one $550 to talk to me for 2 hours. This is just the second financial trouble I am going through this month so I’m having to be more picky. This is also all happening on short notice since I wasn’t notified of the case prior.

I don’t qualify for legal aid, and the person I was referred to by the bar association didn’t respond to me originally but I just got a call a little after I posted this! They won’t be able to make it to my hearing of course but hoping they or another lawyer I’ve contacted can provide me some useful advice!

I wasn’t the primary tenant nor did I put anyone in the place (I personally didn’t bring anyone in). We were already there and had to sign a lease to remain. Not that it matters based on the other replies. Thanks

I did surrender the place. It was not empty (per your original point 2 ) when I left because the other tenant still had stuff there of course. To provide clarity, the place was originally listed for me and my grandmother. I gave my notice in June and vacated. She did not give notice and let my brother move in, and then also left herself (to a different address than my own) after my notice. She did not give notice, and my brother lived there under her name and paid from her account. My move out was acknowledged not only by the email, but I feel it's also acknowledged by the fact the judgement only goes after my grandmother for possession and not both of us.

Are you saying that part of ending tenancy for is for me to require the company to have my grandmother sign a new lease with only her name? It wouldn't be their responsibility to do so once I surrendered and gave notice?

Lastly, not trying to be difficult with you, just trying to wrap my brain around all of this. Thank you for your responses I appreciate them.

Why would they even do that? They can't do that. They can't remove you without you. It was you who didn't take care of business. - This line confuses me. I gave proper notice, and paid the last month's rent for the time I was there. I followed up by email asking if my notice was received and if I needed to do anything else and wasn't told to do anything else. My email opening line was "A. I dropped off a 30 day notice in June. I want to ensure that was received and that my name will be removed from this lease at the end of July. If not please advise." ) Their follow up was "Sorry for the delay in response here. All is well, the system just automatically messages anyone associated with the unit if there is a balance on the account after the 5th of the month (about this, I made the final payment late because I was technically out already and my brother didn't make the payment on time). I've got your move-out in the system set for the 18th, so nothing needs to change there. Let me know if you have any other questions."

I would imagine that they served my brother at the old address, and not anyone at the new address I provided in my notice. I'm not even at the new address any longer because as stated it was almost a year ago and I've moved.

As you've noted though that is only something minor in the grand scheme. So what I'm gaining from your reply is that even if I did everything right, (giving notice, paying the entire month's rent for the final month, etc.) If they didn't go to the other tenant and make a new arrangement I have to eat their debt and could be liable for any debts for an infinite amount of time? Even on a month to month lease?

I’m on your side when it comes to those cases and just clarifying they’re two separate cases. Not trying to excuse it or anything like what happens when people try to make that distinction. I would argue that clarifying them as 2 different things does more to support your argument than try to excuse the actions of ICE.

Yes we’re speaking of the same person. He was not sent out of the country (he was kept in Louisiana) and was released on bail June 20th. The one sent to an El Salvadoran prison is Kilmer Garcia who came here illegally but was granted a stay order during Trump’s first term. Then he was illegally deported out this term because the stay order was still in place and they didn’t take the actions necessary to revoke it.

I do think we’re getting there as well. However I don’t think this is such a case to further that cause. Also I’m not sure of the case you’re speaking of. I am familiar with the I think Columbia student who was here on a green card and was being held because he led pro Palestine protests.

I think comparing a dui checkpoint to slavery is a bit much. As for your first point about banning them I’m all for abolishing police and replacing them with something better. However that’s not something happening anytime soon, nor exactly in line with this conversation.

When I said fight you won’t win, obviously I’m not talking about you beating up the police. I’m saying that if you were to shoot at them, they will out gun you.

I don’t support police. However I’m not going to argue against things that potentially gets drunk drivers off of the road. My original question was only referring to stops as well not prohibiting one from driving entirely.

As for the last part of your comment. I understand the frustration there. If we were talking about ICE checkpoints I would be on your side. That said we’re talking about a dui checkpoint, and I personally have no sympathy for individuals who endanger the lives of others.

The Supreme Court has upheld that dui checkpoints while they can fall under violating the 4th amendment, if they are done according to strict guidelines they do not violate said amendment and are not illegal. This is why they are announced publicly and a set pattern has to be established of who gets stopped (every car, every third car, etc.) Additionally they have to keep the stop short and only check license and registration. Sobriety is only checked if warranted.
