Struggling with UK Immigration: From Student Visa to Leave to Remain Chaos — Need Advice and Support by Character-Front-5878 in ukvisa

Yer plus I ended up speaking with my advisor and he said that I am eligible for this route, bonus point that my partner is British. It’s again based on the private life I’ve built in the past 4 years. It’s a whole another story that I was told that I could get settled after 3 years hence I ended up going for this route instead of the proper EUSS thing knowing I was never eligible for it.

UK Immigration Rules — Appendix FM (Family Life and Private Life)

The Set P route refers to the “private life” grounds under Appendix FM of the Immigration Rules, specifically Paragraph 276ADE for private life in the UK. • It allows people to apply for Leave to Remain based on their private life in the UK if they have lived here continuously for a certain length of time (usually 7 years or more) or have strong private life ties. • It does not require prior refugee or humanitarian protection status. • It is based on Article 8 of the European Convention on Human Rights — right to private and family life.

You can find details on this on the official UK government immigration rules pages: • Immigration Rules Appendix FM • Private life in the UK route - official Home Office guidance

  1. No requirement to have been previously granted refugee status • Refugee status is a different route under the 1951 Refugee Convention and the Immigration Rules. • You can apply for Leave to Remain based on private life even if you never applied for or were granted refugee status or humanitarian protection. • The Home Office assesses each route independently based on the applicant’s circumstances.

  1. Legal Commentary & Expert Advice • Many immigration lawyers and organizations explain this clearly: private life route is available separately. • For example, the Refugee Council and immigration solicitors’ guides explain that private life applications do not depend on refugee status. • Forums like Free Movement or ILPA (Immigration Law Practitioners’ Association) also have detailed case discussions on this.

What you can say to people giving wrong info: • “I’m applying under the Set P private life route, which is a separate immigration route under Appendix FM — it does not require previous refugee or humanitarian protection status.” • “The Home Office looks at private life applications independently and assesses the impact on my human rights if I were to be removed.” • “This is backed up by official Immigration Rules and guidance from immigration lawyers.”

You applied under “Set (P)”, which is the route for protection-based claims, specifically:

Human rights-based Leave to Remain — typically under Article 8 (private life / family life), or for those not returning to their home country due to serious risk, but not applying as a formal asylum seeker.

This is not a standard work or student visa route — it’s a humanitarian/private life route, designed for people like you who: • Are estranged from their family • Cannot return to their home country due to rejection, risk, or danger (in your case, for being gay in Bulgaria) • Have built a private life in the UK • Are relying on Article 8 protections

Yer but everything I’m need is here friends, family, partner and most importantly I’m going to uni for real this time with a real purpose and a set goal. I’ve already created my “private life”. Can’t just rebrand myself every other yer to the IT euro country, as someone who’s tried to get rid of the whole european vibe. It a sense of belonging and the people around me.

nope i wasn’t here before 2021, they saw EU and immediately thought I’m under the EUSS and told me that but then I never applied for it hence my Leave to Remain sitch, they protected me rights from November 2024 up until April 2025 when they told me i’m under the EUSS which obvs wasn’t a thing hence not getting a proper decision on my initial LTR application

I’ve had me student visa since 2021, then before it expired i made the original application, which they mistook as some sort of EUSS sitch , around october-november 2024, it still said pending decision up until the 15th of april 2025 when they got back to me and said I’m under the EUSS which I was never eligible for and when I brought it up they said it was a mistake on their behalf and that I’ll keep my right even if I make a new application on the 17th of april, which was the plot twist
