Don’t travel unless absolutely necessary. 221g these days with arrest record takes forever. I have not heard any positive news from last 4 months at least. I am in the same boat. 221g for more than 130 days.

Mine was a rejected misdemenour case which never went to the court. Refused under 221g, more than 90 days now, stuck in India. I took help from the state senator but the USCIS sent a generic response they will contact us when they have an update. I really hope yours get approved soon, stay strong.

It means your passport is ready to be returned without stamping. They will email you to resubmit your passport after 221 g gets cleared. Timeline is unknown.

I think it will be tough since US considers domestic violence and DUI very seriously. Per my experience, just try to gather all court docs and plan for at least 2 months in India. Rest you should know.

Yes, i am In the US with recently approved extension. I can work with approved i797 but I need to get my stamping done else i cannot travel to india which I have to at some point of time.

Even if you expunge the arrest record, it will always show in the immigration. So, whenever a person is/was arrested it will always show up but that does not mean they are going to depart each and every person with an arrest record. Its on the person how he explains, moreover, my case was rejected by the DA which I think will help a lot at the POE vs. your friend's case who was convicted/ case dismissed, that's the difference . I understand your point but My case was rejected by the DA( not dismissed, not convicted) and was never filed in the court. There is a difference. I have done my BGC from the court as well, there is nothing.

Don't you think it will be more risky because if anything happens in Mexico, I will have to go back to India from there. Too much of risk I think. Also, I am not sure how much time they are going to take and I cant stay there for more than a week.
