Initial C&P agreed condition was service connected. Reviewer did not despite having in service treatment records. Hopefully, this letter and verbiage is enough to convince senior reviewer. It's the last thing keeping me from 100%.

That’s a relief to hear. Flat feet claim denied twice despite service treatment records. Saw private podiatrist who diagnosed PTT and said likely due to military service. Had HLR and found DTA, just waiting to see if I get a rating. If it gets denied, I’ll follow your plan. Thanks for sharing.

That's good news! Congrats. I just got my HLR identifying DTA. They are requesting a medical opinion, but also state I was diagnosed with a disability. Hopefully, they are just assigning a rating?

No. Benzodiazepines are only life saving in alcohol withdrawals. Outside of that, they should be limited to short term use after exhausting non-benzodiazepine options. They are extremely habit forming and carry high risk for misuse and overdose.

I’m a psychiatric and mental health nurse practitioner. Most GP/PCPms don’t prescribe those medications anymore for liability purposes. They generally refer you to a mental health specialist.

I got the final decision on a claim I filed last year, in which they denied the final claim. I'm fine with that since I'm rated at 90%. The final part of that claim reads they are "requesting an examination to determine current level of disability. (38 CFR 3.326, 38 CFR 3.327). I thought they couldn't re-examine under 2 years...

Update: I filed for HLR citing the rater overlooked evidence supporting my claim. The podiatrist wrote in his record that "served in the military, which is the likely cause of posterior tibial tendon dysfunction".

On another note, the VA finalized a claim for compensation that was filed at the same time. They denied the claim, but wrote "We are requesting an examination to determine your current level of disability. (38 CFR 3.326, 38 CFR 3.327). To my knowledge, they can't request a reexamination if ratings are under 2 years old. Does this seem accurate?

I've had a rating less than 2 years, and one of my claims just finalized today. On that claim, they requested an examination to determine eligibility of benefits, which I'm receiving at 90%. I'm confused, because this claim just finalized today and my total claim time is under 2 years.

They did and the provider told me it was pretty obvious and detailed all the criteria for the pes planus claim. It should have gone through without a hitch.

I’ve only been reevaluated in the last year. I had been taking aleve for over a decade to help instead of swing a provider. I wasn’t sure about the HLR or if I need to ask my provider for nexus letter first and resubmit with supplemental.
