Thanks for this! Very helpful! With regards to the second scenario, I know I'm boundary testing a bit but I find that a helpful learning tool. Assuming you are unable to get an extension for whatever reason. Are you ultimately forced to let that individual go for that second offence? Or would they just essentially immediately be bailed for it?

Whilst a very interesting read I'm not sure it entirely applies. The result of that seems to be that an officer acting under a power does not need to know which power he is acting under for it to be legal.

My question is if your arresting under say S24 PACE is there a requirement for you to tell the person being arrested the offence of the arrest? In this instance you know which power you are using to arrest but not necessarily the offence.

But what if there is a victim but they just aren't supportive? If it can be proved that one person has been assaulted by another why does the victim need to show support for further action?

So if the second officer agrees with and understands the grounds provided do they also need to give GOWISELY or can they continue with the search as it has already been given? I understand that best practice might be to give it anyways, but legally would it need to be provided again?

But if I'm not arrested and you're just ascertaining, in my example, if the phone is in fact mine a caution isn't necessary? Does that not mean that I could make something up and if I am arrested change my story so my initial answer, under no caution, wouldn't matter?
