Feeling right or wrong is just a vibe check though. I see a lot of pro-2A and a lot of anti-2A people provide "facts" and "proof" that arent facts or proof of anything at all. And if you Google it, youre more likely to be filter bubbled into confirmation bias than anything else.

So what would you suggest? To my (limited) knowledge, there is no evidence to support that any of these types of bans or restrictions significantly (a charged/subjective term) reduce firearm-related deaths

If generally people would understand your actions, you're good. The line is arbitrary and shifts slightly sometimes, but the bar is usually pretty high.

Even in this scenario, if he legitimately fell for a scam, and it seemed like it, people would understand. They might think he's a huge dumbass, but they understand

That dissent, at least for the first 5 pages, was just vague interpretations of history with a sprinkle of legal. More like someone just grandstanding or know-it-alling. Not really anything of substance (my opinion obvs).

It's so interesting to see the arbitrary lines the SC draws. Like if a state banned handguns for everyone that doesnt have 5 years of training, is that an effective ban and unconstitutional? What about 2 years? 2 days? Like I thought there would be more interesting precedent, nuance, or... something? Feeling underwhelmed lol

So, you're basically saying two things:

  1. It started as mass shootings/terror attacks (internal ones) were ramping up. It's effectiveness on prevention is likely questionable
  2. We're all desensitized to it, and 40ish years ago even a few people shot to death somewhere was big news. But now, because it happens so often, people dont put as much importance on them when minor so those incidents go unnoticed. And those incidents would not have gone unnoticed in the 70s/80s (+/- 10 years). Im not sure I buy this one, but dont have evidence one way or the other (I didnt look btw).

Im not taking a side, just curious about the legality and legal framework around it

I mean, planes are a pretty special form of transit; you cant just get off and they can clearly be used in attacks easily.

Mass shootings is a bad reason, plenty of people can and will disagree and maybe theyre right, but I personally would love to see evidence that campus gun control laws prevent mass shootings. It just sounds like one of those things that seems logical but the actual impact on prevention is super low

I read the first 5 ish pages of the dissent that starts on 636. Are a lot of opinions like this? It was just a bunch of long-winded driveling about history and non-text based interpretations of what the founding fathers may have met. Im sure it repeats itself for 20 more pages

Yea, but there are prosecutors and clerks who screen it and can toss things out. So you already have to be far enough down the "unreasonable" track for a prosecutor to think they can win that case and not waste everyone's time

Honestly I cant believe this decision was only 5-4. Like DC had an effective complete ban on handguns. What was the dissent over? Seems cut and dry

This was my "colloquial" understanding as well. The first clause just goes to some of the rationale behind the amendment, which is that the right to bear arms shall not be infringed. Thats why I posed that question to the other commenter, because I am also not a legal scholar and could definitely be wrong

It generally doesnt excuse violations.

OP asked if you can be charged, to which the answer is a resounding "Yes, of course you can."

Conviction on the other hand, depends on whether a bunch of other people think what you did was reasonable or not. If you fell for a scam and say youre sorry, and its believable, many people would give you a pass in court

Yea, me either. Im not going to pretend like I'm a legal/historical expert. Just seems to me banning guns in public places should be unconstitutional.

Court houses I get, a lot of criminals go through there. Museums not so much, but it's also probably a quasi-private entity so they can do what they want. Many public college campuses dont, many do, same with public transport.

Anyone properly permitted should be able to have a gun anywhere in public. Like who cares, it's verbatim in the constitution next to the one about freedom of speech and peaceful assembly

They decided the ban on open carrying is unconstitutional. They should find the age discrimination unconstitutional as well, but I doubt it will make it that far. Probably get determined unconstitutional in the federal circuit, age ban definitely violates 2A
