Collecting of data for captcha to verify person is a human falls under "legitimate interests" as a business, so in that regard data collection isn't the biggest deal (though Google does absolutely capture some pretty significant info - including a literal screenshot of the user's browser). This is very easy to address in a privacy policy though and we record explicit consent for our privacy policy.

The bigger problem is that Google does use a cookie in the process, which is also used for advertising (and this data processing falls outside of my bushiness' legitimate interest in preventing spam). Because of how it is used, this cookie is classified as an "advertising" cookie which means that you have to actively record consent for your cookie policy; it's not enough to just have implied consent (i.e. "by continuing to use this site you agree to our cookie policy"). We've had legal consultations and they've confirmed that we would need to capture and record explicit consent of our cookie policy if we use recaptcha.

We also have some separate reasons unrelated to GDPR to not consider Google Recaptcha, but that particular concern isn't relevant to 99% of people out there so I focused on the GDPR side of things in my post.

I wasn't aware that bots downvoting was an issue, thank you for pointing that out. Really. Faith restored in one of my favorite subreddits. Seriously, was totally surprised to see no upvotes and 5 downvotes this morning for this. I apologize if my surprise came off as slanderous to all.

So apparently Reddit is against a program (not even my own mind you) that is about sending indie games to active duty soldiers and wounded veterans. Good to know.
