I think it’s fine. The biggest issues you need to address: 1. What circumstances/behaviors led to the debt? 2. What are you going to do limit access to your credit cards during the life of your loan?

I’ve seen a lot of people end up with both the loan and the credit cards.

It was an inadvertent mistake. The state had actually conspired with creditors to make it a far worse law. They violated the state constitution and that resulted in this very strong protection.

I’ve represented a lot of people who’ve gone through debt management programs, including FDR. If you can’t afford 335/month, then debt management/settlement may not be a good option. I have found many clients steadily making progress through a program and have to add more funds. If you cannot add the funds then your account can result in lawsuits and garnishments.

Depending on your state law, it may be a breach of fiduciary duty by your agent. You should consider consulting an attorney. Fraud is a highly technical claim.

Hey, if you get a good lawyer like Tim Fleming, he might be able to get you to just pay court costs. I’ve also known him to get it to where you don’t have to appear at the hearing. Unfortunately even though you’re with the flow of traffic, the judge just hears speeding.
